Baker Johnson Lamar briefly married to Cornelia Kemp [11 April 2022]

The marriage was forced and following it they never lived together and the marriage was subjet to a lawsuit. Baker J. Lamar vs. Cornelia E. Kemp, alias Lamar #3175 Equity, Circuit Court Frederick County. The deposition below tells the story!

At the execution of the annexed Commission issued out of the Circuit Court for Frederick County and to me directed and empowering me to examine evidences in the cause depending in the said Court between Baker J. Lamar, as Complainant, and Cornelia E. Kemp, alias Lamar, as Defendant, I, William B. Nelson, Commissioner therein named, did, on the Sixteenth day of December Eighteen Hundred and Sixty four, as my office in Frederick City, Md. then and there proceed to take testimony in said case, but there being no witnesses present to be examined and the Complainant requiring further time for the production of his evidences, the said Commission was adjourned to the Twenty third day of December December Eighteen Hundred and Sixty four at which time and as the place aforesaid, I proceeded then and there to take the following depositions, to wit: William Kemp Answers to Interrogatories deposes and says: 1st: Are you acquainted with the parties this suit, to wit: Baker J. Lamar, Complainant and Cornelia E. Kemp now known as Cornelia E. Lamar, Defendant. Witness: William Kemp That he knows the parties to this suit, that Defendant is deponents sister. Witness: Charles Wesley Kemp: That he is acquainted with the parties to this suit-that Defendant is his sister. 2nd Were you or not present at the house of Peter Kemp in this County, together with said Baker J. Lamar & the said Cornelia on or about the 27th day of June 1864. Witness: William Kemp: That he was. Witness: Charles Wesley Kemp: That he was. 3rd. State how the said Baker J. Lamar came to be at said house on that day, state if you had anything to do with his being there at that time and all that occurred between you and said Baker J. Lamar or between said Baker J. And any one else in your presence at that time previous to said Baker J.s going to said house. Witness: William Kemp: They went with his brother Charles Wesley Kemp from Frederick City in a hack to the farm on which Complainant was at work and he called Complainant from the field and handed to him a note from Defendant that he became very much unnerved so as scarcely be able to read the note-deponent then suggested to him whether it would not be best for him to (Complainant) to go over and marry Defendant without any further difficulty in the matter-Complainant refused then to marry Defendant and proposed to pay the money if any money was to be paid in the case deponent then asked him to go over to the house and discuss and consider the matter over-this Complainant refused to do excusing himself by saying that he would have to go the farm house and change his clothes deponent and his brother also objected to this Complainant then said that he would get his horse and go over to see Defendant-deponent and his brother objected to this arrangement as they feared that if Complainant got his horse, he would go out of the way-Complainant finally got into the hack with deponent and his brother-that on the road deponent asked Complainant if he had made up his mind to marry Defendant, to which he replied, that he had not. Witness: Charles Wesley Kemp: That deponent went with his brother William upon the occasion referred to-that they called Complainant from the field where was at work at the time and gave him a note sent to him by Defendant-that Complainant was very much unnerved-that deponent insisted that Complainant should go with them to their fathers house and marry the Defendant-after making sundry excuses Complainant got into the hack and went with the deponent and his brother to the house of Jacob Kemp their father-that Complainant was asked on the road ??? whether he had made up his mind to marry Defendant to which he answered he had not. 4th Did you or any one else in your presence use any threats towards said Baker J. To induce him to go to said house, if yea ???? What threats were used. State all that occurred and was said by any of the parties there present at that time. Witness: William Kemp: That when we got to deponents fathers house deponentss father spoke to Complainant about the matter and tried to persuade him to marry Defendant-deponent then told Complainant that he and his brother had come to make him marry Defendant and that he must do it. Witness: Charles Wesley Kemp: That when we arrived at fathers house deponents father spoke to Complainant about the matter of marrying Defendant-that at this time deponent and his brother told Complainant that we had come after him to make him marry Defendant and that he would do it. 5th After arriving at the house of the said Peter Kemp state the names of all the parties then present and what was then and there said and done. Witness: William Kemp: That deponent, Charles Wesley Kemp, John Poole and Jacob Kemp were present at the meeting at deponents fathers house-deponents father advised Complainant to marry Defendant and tried to induce him to do so-Complainant then said the he would like to consult with his friends about the matter- deponents father then proposed that Complainant should go upstairs and see Defendant to this Complainant finally consented and did go upstairs to see Defendant and Complainant finally consented to marry Defendant-that after some time Complainant and Defendant came down stairs together and were married by the Rev. McClain. Witness: Charles Wesley Kemp: That there were present at the deponents fathers William Kemp, brother of deponent, Jacob Kemp, father of deponent, John Poole and deponent-deponents father advised Complainant to marry his daughter, the Defendant, and tried to persuade him to do so-that Complainant said the would like to consider with his friend about the matter.' 6th After arriving at said house did any person or persons ask or require of said Baker J. Lamar that he should marry the said Defendant Cornelia E. Kemp? If yea, state who such persons were and what was said upon the occasion and what was your manner. Witness: William Kemp: Answered in foregoing Interrogatories Witness: Charles Wesley Kemp That after arriving at Jacob Kemps, William Kemp, Jacob Kemp and deponent required of Complainant that he should marry Defendant and their manner was such as to force upon Complainant the conviction that he must marry the Defendant or subject himself to disagreeable consequences. 7th If you state that some person or persons did ask or require of said Baker J. Lamar that he should marry said Cornelia E. Kemp, state further what was the reply of said Baker J. Lamar to such demand. Witness: William Kemp: That Complainant was told by deponent and Charles Wesley Kemp that he not leave the house until he had married Defendant- that deponents manner was excited and was calculated to impress Complainant with the conviction that he must marry the Defendant on the spot Witness: Charles Wesley Kemp: What Complainant was told by deponent and William Kemp that he could not leave the house until he married the Defendant-deponents manner was excited and was calculated to impress Complainant with the conviction that he must marry the Defendant. 8th Did or did not the said Baker J. Lamar then and there refuse to marry said Cornelia? Witness: William Kemp: That Complainant so long as he was down stairs refused to marry Defendant Witness: Charles Wesley Kemp: That Complainant refused so long as he was downstairs. 9th Did or did not some one or more persons upon that occasion threaten the said Baker J. unless he would consent to marry said Cornelia and did not some one then and there produce a pistol for the purpose of intimidating said Baker J. and did not the party producing the pistol then and there threaten to shoot or kill said Baker J. unless he would consent to marry said Cornelia? Witness: William Kemp: That from the manner of deponent that occasion the mind of the Complainant was so acted upon by fear of consequences that he consented to do as required of him, that no one, at that time, threatened to shoot Complainant if he did not consent to marry Defendant-that there was no pistol produced on that occasion in the presence of the deponent. Witness: Charles Wesley Kemp: That from the manner of deponent on that occasion the mind of the Complainant was so acted upon by fear of consequences-that he consented to do as was required of him-that when Complainant was upstairs deponent did threaten to shoot him if he refused to marry Defendant-that was the inducement to Complainant consenting to marry Defendant- 10th Were there any other threats made by any person or person at that time against the said Baker J. to induce him to marry the said Cornelia? If yea, state what such threats were and by whom they were made. Witness: William Kemp: That there were no other threats used that already before stated. Witness: Charles Wesley Kemp: That he knows of no other threats used except as heretofore stated. 11th Do the said Baker J. Lamar and the said Cornelia E. Kemp. Then and there enter into matrimony with each other"" If yea, state the name of the minister officiating upon the occasion. Witness: William Kemp: Answered in foregoing Interrogatories Witness: Charles Wesley Kemp: Answered in foregoing Interrogatories. 12th To the best of your knowledge have not the said Baker J. and the said Cornelia lived separate & apart since this marriage, and has not said Baker J. steadily refused to acknowledge said Cornelia as his lawful wife? Witness: William Kemp That Complainant and Defendant have lived separate and apart since their intermarriage-knows nothing further. Witness: Charles Wesley Kemp: That Complainant and Defendant have lived separate and apart from each other since their marriage and that he knows no more than already stated. 13th Was not said Baker J. Lamar brought to consent to said marriage with Cornelia E. by reason of fear or in consequence of the threatening manner or threatening tone of voice toward him by you & others? Witness: William Kemp: That he presumes that he was. Witness: Charles Wesley Kemp: That he presumed that he was. There being no other witnesses present to be examined and the Complainant requiring no further time for the production of his evidence to the Commissioner closed the said Commission and herewith returns the same under his hand and seal, this 24th day of December in the year Eighteen Hundred and Sixty four.
