pg. 37: Memorandum. The is as appears from the dec'd Books due from James Chandler the sum of nine shillings & nine pence.
Suit has been instituted in Tennessee against the heirs of Campbell to recover back the costs expended in defending the heirs of Samuel Wallace at the suit of Buchanan, Campbell & others against them in chancery the costs of which have been by consent of the heirs paid out of the Estate of Wm. Wallace there for whatever sum may be rec'd. after paying the expenses of collection & ___ will hereafter be to distribute amongst the heirs of Wm. Wallace.
Note A. The entry of $697.65/100 which refers to this note does not include any part of the costs deemed to be the heirs of Samuel Wallace, at the suit of Wallace's heirs against Grigsby & others, for this reason: I was appointed by the consent of all the heirs of Samuel Wallace, their agents to attend to & manage the suit then depending against Grigsby & others, for which it was understood that I was to be paid for my expenses & trouble out of the estate of William Wallace in the event of our failing against the Defendants Grigsby & C.: having succeeded against them. I have only charged the heirs of Samuel Wallace for my agency the amount of the costs decreed them in said suits. wherefore I have not carried any part of the costs recovered to the credit of William Wallace's Estate.
