This Indenture made this 10th day of October in the year 1855 between Elisha Gates of the County of Nelson and Commonwealth of Kentucky of the one part and William R. Gates of the County and Commonwealth aforesaid and John G. Gates of the state of Texas of the other part. Witnesseth. that the said Elisha Gates for and in Consideration of the natural love and affection he has the said William R. Gates and John G. Gates his children, hath granted bargained and sold and by these presents doth grant bargain and sell unto the said William R. Gates and John G. Gates their heirs and assigns all that tract or parcel of land situate and being in the County of Nelson on the waters of Fromans Creek and bounded as follows. Beginning at two elm trees on the west bank of Fromans Creek (a corner to Sims and Froman) and running with Sim’s line N 79½, E193poles to two dogwood bushes corner to Sims, in Riches line, thence N11¼, W104½ poles to a hickory and dogwood corner to Wm. Sims, thence with his line S79½ W204½ poles to four sycamore trees in the middle of Fromans Creek a short distance below the Mouth of Rogers run thence up the middle of Fromans Creek to said run and following its meanders to a stone near a buckeye tree on the East Branch of said run the four courses S10 W22 poles S63½ W20 poles S46 W18 poles and S11 W 33¼ poles. Thence S67¾.E77 poles to the beginning containing one hundred and fifty three acres together with all and singular the appurtenances there wits belonging or in any wise appertaining. To have and to hold the land hereby conveyed with the appurtenances unto the said William R. Gates and John G. Gates their heirs and assigns forever. But nevertheless the aforesaid tract of land and appurtenances is conveyed to the said William R. Gates and John G. Gates as an advancement and on the following conditions. The 153 acres is estimated and valued at eighteen dollars per acre making the sum of twenty seven hundred fifty  four dollars which the said William R. Gates and John G. Gates are to account for on a settlement and division of the estate of the said Elisha Gates among his heirs after his death and they are not to account for interest nor rents on said land, and they the grantees accept this deed of conveyance on the terms and conditions aforesaid.  

In witness whereof the said Elisha Gates together with his wife Christina Gates who hereby relinquishes her right of dower in and to the lands hereby conveyed in this deed...

In the name of God Amen. I William Raymond Gates do hereby declare this to be my last will and testament to wit. Article 1st I will that my funeral expenses and all my just debts be paid and that twenty Dollars be given to the pastor of St. Gregory’s Church for masses to be said for the repose of my soul. Article 2nd I leave all my real estate to my beloved wife Elizabeth Gates during her single life, the proceeds of said real estate, or as much of it as necessary therefore to be employed for the maintainance [sic] and education of my children who are now minors. Article 3rd Of a life policy which I hold I make the following disposition to wit all expenses that may accrue in said policy, from the date of this will are to be paid out of the proceeds of said policy. Of what remains I desire one half to my beloved wife, Elizabeth Gates, and the other half to my children to each an equal part & to be paid to them as soon as collected except the portions falling to the five youngest children. Article 4th I will that all the stock, implements, provisions & all necessaries for conducting the farm be retained and my executors shall be the judge of what shall be retained. Article 5th The remainder of the rest of my personal estate I will to be equally divided among my children. Article 6th If after the expiration of ten years from the date of my death, my wife and such of my children who have then attained their majority should mutually agree to make other arrangements with regard to the real estate than those provided for in this will I hereby empower them to make such disposition of it as they may agree upon. Article 7th I hereby appoint my sons George Elisha Gates and James Truman Gates together with my brother John G. Gates the executors of this my last will and testament Drawn(?) at my residence in Nelson County Kentucky this twenty second day of November in the year of our Lord one thousand eight hundred & eighty one....
