James Smith, Deft. ) appurtenances on two small creeks, branches of Clinch River, in this County of the demise of Alexr. McClenachan, Wm. Shelton & John Shelton.
This day came the parties by their attornies & thereupon came also a jury, towit: Alexr. Collier, Moses Collier, Aaron Collier, Felty Cook, John Douglass, James Hollis, John Litton, Dawson Wade, John McMullin, Thomas Carpenter, William Galloway & John Galloway, who retd. verdt. in favor of the plff. and damages of one penny, beside his costs.

Judgment for the same and costs.

Monday, October 27, 1788.
Also, a petition of William Galloway, of the county of Botetourt; setting forth, that he was seized by a deed from his father and upwards of thirty years possession of a tract of land in the said county, of which he was afterwards divested by authority of an old grant to Robinson Burden Lewis and Company; that the claimant under them being a British subject, his estate was escheated and sold for the benefit of the Commonwealth; and praying to be reimbursed for his buildings and improvements on the said lands out of the proceeds of the sales thereof.
Ordered, That the said petitions be referred to the committee of Propositions and Grievances; that they do examine the matter thereof, and report the same, with their opinion thereupon, to the House.
Resolved, that it is the opinion of this committee, That the petition of William Galloway, praying that the amount of the sales of seventy-two acres of land in the county of Botetourt, which was escheated and sold by the Commonwealth, as the property of the heir of John Graham, deceased, a British subject, and taken from the petitioner's father prior to the late revolution, by a survey and grant to James Wood, who conveyed the same to the said John Graham, way be paid to hint by the public, be rejected.
