SUBJECT OF TRANSACTION: Recites mortgage dated 2 Feb 1738 whereby Samuel Gardner demised messuage in Horsefair, Banbury, on the North side, and another messuage on the South side, to Richard Wheatley for 2,000 yrs for securing payment of £100 with interest Recites assignment dated 2 Dec 1776 whereby ppty was assigned to Oliver Aplin for the residue of 2,000 yrs. for the use of Robert Tate Recites conveyance dated 30 Dec 1776 whereby the ppty was conveyed to John Rushworth for ever Recites will John Rushworth dated 8 March 1809 whereby he devised all his freehold ppty in Banbury to John Heydon for ever Recites that John Rushworth died in April 1814 and that his will was proved 23 July 1814 Recites will of John Heydon dated 31 August 1814 whereby he devised his residence in Bull Bar Street (which in 1814 he had separated from the ppty devised to him by John Rushworth by a wall) to Richard Heydon for ever Recites that John Heydon died in March 1818 and that his will was proved 14 April 1819 Recites will of Oliver Aplin who appointed 1. as his executors Recites that Oliver Aplin died in April 1831 Recites Lease and Release bearing even dates with these presents whereby 2. conveyed the ppty to 3. for £1, 900 to the use of 1a. to hold to the use of 3. and his heirs for ever. Recites agreement that such of the premises as are subject to the term of 2,000 years should be assigned to a trustee for 3. Now in consideration of the agreement and £1,900 paid by 3. to 2., and 10s. paid by 4. to 1., 1. at the direction of 2. and at the nomination of 3. transfers to 4. those parts of the premises conveyed by the redited Lease and Release as are subject to the term of 2,000 yrs, in trust for 3. to attend the freehold inheritance PLACE(S): BANBURY ENDORSEMENTS: (c) Other endorsements: Engrossed 6 Aug 1831
