Parentage of Walter Smiley

Note: Walter Smiley is suspected of being a son of Walter Smiley, Sr., brother of Alexander Smiley, who left records in Augusta County, Virginia. More research and records are needed before this relationship is proven. There is another Walter Smiley, probably a cousin of this Walter Smiley, that could be confused by some researchers.

In the name of God, Amen.

I Walter Smiley of the County of Boutetourt in the State of Virginia being weak of body but of perfect mind and memory calling to mind the mortality of by body knowing that it is appointed for all men are to dye do make & ordain this my last Will and Testament in manner of following:

First, I recommend my soul to God who gave it in all living in hopes of a blessed imortality through the merits of my Returning, and as to my Body I resolve it to the Earth to be buried in a decent Cristian like manner with full assurence that I shall receive the same at the general resurrection by the mighty power of God.

As to makeing such worldly estate where with it hath pleased God to bless me in this life I divise and dispose of the same in the following manner.

It is my will that all my just debts and funeral charges be paid out of my personal estate.

I will & bequeath to my son Alexander the plantation whereon he now liveth in Rockbridge County on the South River.

I will & bequeath to my son George the plantation whereon he liveth in Rockbridge County adjoining the above mentioned land. also fifty pounds out of the money due me from my son Alexander for a piece of Land I sold him.

I will to my son Daniel five shillings for his proportion of land I have made a title to.

I will and bequeath to my son James the plantation whereon he now lives it being the upper end of the plantation where I formerly lived adjoining the land of Joseph Poalk, the dividing line beginning at my line of the South side of the creek on the clift oposite to the bend in the Creek near the mouth of little Catawbo running down the creek to the mouth of a gully coming in on the North side of the Creek from thence running a strait line parellell with the (lift or left hand) fence to the line west the north Mountain.

I also give to my daughter Nancy the middle part of the plantation above mentioned Including my dwelling House & all the land being part of two surveys, between the line above mentioned & the line of the land I have conveyed to Jones for my son Daniel, during her natural life after her death, to be sold and divided amongst her six children also my bed & furniture & a large Iron kettle & oven which is now at my son James's.

It is my will that anything that should remain of my Estate which I have hereby not disposed of should be divided equally amongst my children or their heirs.

I do hereby nominate and appoint my two sons Alexander & George executors of this my last will and Testament and do hereby revoke and make void all former other will and testaments by mimade? pronouncing & declareing this to be my last will and testament his? witness where of I have hereunto set my hand and seal this 26th day of May in the year of our Lord One thousand eight hundred & one.

This Instrument of writing purporting to be the last will and testament of Walter Smiley deceased was exhibited in court and proved by the oath of Edward McDonald and George Eodzler (?) witnesses thereto. Subscribed & is ordered to be recorded. A copy/teste Bowyer DC"
