The chancery suit that is included is interesting, and it lists a Benjamin GRAYSON that I can not identify. Unfortunately, most of the persons listed in the suit are not identified. That is what I'm trying to do now. Since there wasn't enough room to include all my notes, I'm doing a second posting with some more Chancery notes. Looking forward to your input. Janet iv. THOMASIN7 ELLZEY, d. Aft. 1800. The first mention of Thomasin (or Thomazin) ELLZEY that I have found states, "Thomazin ELSEY assignee of Capt. Lewis ELSEY of Fairfax county, 15 February 1752, survey n.d.; 396 ac...on Tuscororah Crk; adj Wm. PATTERSON...." 27 May 1762 - He purchased 270 acres on drains of the Pohick; adj. ELLZEY's own, Col. GRAYSON and others. (FCCR) 30 November 1762 - He purchased 244 acres of Col. CARTERS Ox Road on S drain of Pohick; adj. Bond VEAL, Wm. ELLZEY, Geo. SIMPSON, and others. (FCCR) 2 February 1765 - the minutes of Pohick Church, Truro Parish, states, "To Mr. Tomzon ELLZEY for running the line from JOHNSON's Ferry to the fork of the Difficult, 1,333 pounds of tobacco." Thomasin was a vestryman at Pohick Church from 1765-85 and a church warden in 1767-8, 1772-3, 1776-7, and 1781-4. 6 April 1765 - 544 acres on drains of Pohick, Rattlesnake Br., branch of Pope's head where Ox Road crosses road to Alexandria; adj. Col. CARTER, Capt. ELLZEY, Col. GRAYSON and others. (Fairfax Co. - Northern Neck Land Grants) 6 June 1767 - Assignee of Thomas Bryan MARTIN and surveyor for 888-1/2 acres of land on Elk Pasture located over first main spur of Allegany Mt. from New Creek on Great Run on North Branch of the Potomac which included head of Maple Run, Rattlesnake or Camp Branch and adjacent his own land. (Hampshire Co. - Northern Neck Land Grants) 26 February 1768 - 190-1/2 acres on Difficult run near the Ox Road. Richard HEYDON obtained a warrant on this land in 1766 - apparently there was some dispute as the records state the Lord FAIRFAX decided in favor of Thomazin. This is surprising as traditionally Lord FAIRFAX and the ELLZEY family were not supporters of each other. This land was adjacent to Thomazin's father, Lewis ELLZEY 17 August 1768 - He purchased 441-1/2 acres on both sides of Beaver Run drain of Patterson's Creek. (Hampshire County) 20 December 1769 - Thomasin is mentioned as a boundary in a land survey of William BAILEY. Thomazin owned 407 acres. (Berkeley County) He appears on the Rent Rolls of Fairfax Co., VA, in 1774 along with his father and half brother, William. The Virginia Publick Claims for Fairfax Co. indicated he supplied 590 pounds of beef for the Continental Army and received 9.16.8. (Virginia Publick Claims, Fairfax Co., V, compiled and transcribed by Abercrombie and Statten, p. 16) The 1787 tax list of Fairfax Co. shows him with 1 black male over 16, 1 horse, and 6 cattle. He is mentioned in both his father's and mother's wills. His father willed him land and slaves and made him trustee of his sister's (Stacy) legacies. Lewis stated, "I give and devise to my son Thomasin tracts or parcels of land, containing about one thousand and sixty acres, also one other tract of land situate on Pohick in the County of Fairfax containing one hundred and seventy one acres, also one other tract of land adjoining the last mentioned, granted to me by the Proprietor of the Northern Neck.... But it is my will and desire that my son Thomasin disturb not his mother in the peaceable enjoyment of the lands and plantation whereon I now live but that she hold the same during her life. Item I give to my son Thomasin ELLZEY my negro boy named Nelson." After the death of his mother, who had been given 13 slaves with the exception of one named young Will, the 13 slaves were to go to Thomasin and his sisters, Stacy, Sarah, and Sibyl. Thomasin along with his brother-in-law was named executor of his father's will. Records that I have found indicate that Thomasin never married. Thomasin was an original purchaser of town lots in Bath in 1777-1798. He purchased lots #72 and 130. Thomasin was a county surveyor for Fairfax Co., during the 1789s. On 30 November 1796, court records from Alexandria state, "...William PAYNE the surveyor of Fairfax Co. is requested in conjunction with George GILPIN and Thomasin ELLZEY to have the original plan of the Town of Alexandria inserted in the record book for the corporation and Town aforesaid, together with the minutes of the surveyors relative to the said Town." On 27 March 1797, Tz. ELLZEY, George GILPIN, and W. PAYNE, SFC, signed that they had done as they were required. In 1793, Thomasin, of Fairfax Co., sold to Elias POSTON of Hampshire Co., VA, 276 acres on the Little Cacapeon River. In 1800 and 1801 Thomazin had a license for an ordinary service. (LDS film # 29295, Fairfax Co., VA, Personal Property Tax Lists) On 7 August 1813, he provided security for the guardian bond for Mary, the child of John COFFER, dec'd. Thomasin died between 1813 and 24 July 1817. Estate records show that his coffin was paid for 24 July 1817. Rev. William DUNN was paid 4 April 1819 for preaching the funeral. Thomasin held land in Fairfax, Morgan, Hampshire, and Hardy Counties. In Fairfax Co. WB Q, p. 112, a list of land of the "late Thomazin ELLZEY that was sold by the Commission under the Acts of the General Assembly of Virginia." Land was sold in 1824 and purchasers were John SHERARD, Robert ALLISON, Thomazin GRAYSON, Edward BLACK, Loyd WARD, and others whose names were too unclear to read. Fairfax Co. court records that his heirs were being paid from his estate as late as 1831. There is some connection between Thomasin and the LACEY family of Loudoun Co., but I have not looked into it yet. The Loudoun Co. Chancery Suits 1757-1874 (Index) lists Thomazen et al as plaintiff and a David LACEY as the defendant. The year was 1813 - which was the final date of the suit, not the original filing date. Also a Sally LACY of Loudoun Co. was among the heirs to whom money from the estate of Thomasin was distributed in 1826. In the account of Thomasin's estate of 19 March 1829, she was listed as Sally LACY MANNING. Inventory of Thomasin's estate was recorded 20 August 1817 and listed very few items: 1 Dictionary and sundry old books, 1 ink stand and mahogany box, 3 sheets and 1 table cloth, and an old apple still Total was 66.21. They are the only people identified in this document and the other two documents that name all the representatives of Thomaszin ELLZEY. CLARK Edward, John, Mary, Ann, and Sarah PORTER - These may be children of Thomazin PORTER. Benjamin GRAYSON - Could be the son of Stacy and Benjamin GRAYSON or he could be the son of Ambrose GRAYSON; however in all three documents that list these names, his name is always last and not listed with the names of the other children of Ambrose. |
