"In the Name of God Amen, I Thomas Trevithick Senj residing in Pump Field at Pool in the parish of Illogan in the County of Cornwall being of sound mind and perfect recollection here maketh this my last Will and Testament in the following order: 1st the House in which I now reside I bequeath to my beloved Daughter Eliza Trevithick on the following conditions first during the time she remain single and continue prudent the full possession of the house and furniture (except what is otherwise ordered2nd when she do get married she is to pay to her beloved brother Thomas Trevithick and for his own use and purposes the sum of thirty shillings lawful coin of the realm annually and also ten shillings and three pence annually the amount of Convention any rent and expenses of dinner at the Court to which he shall attend and ay the said money to the Steward of the Manor at the times and place appointed3rd She is also to pay unto her beloved Sister, Mary Gilbert the sum of Fifteen shillilngs lawful coin of he realm annually and for her own use and purposes during the term of her natural life4th In case my beloved son Thomas Trevithick should survive my Daughter Eliza Trevithick aforesaid he is to have possession of he house on payment to his Sister Mary Gilbert the sum of twenty shillings annually lawfull coin of the realm for her own use and purposes5th Should my beloved Daughter Elizabeth Prideaux who is now in North America return to this country again I bequeath to her the sum of ten shillings annually lawful coin of the realm for her own use and purposes to be paid her by her brother and Sisters or any of them who may then be alive each one contributing heir proper proportions6th Should my beloved Grandson, Wm Hunter return to this country he is to be accommodated with a home in this house for himself during a term of six months after which term he shall remove from this house and receive the sum of ten shillings annually to be paid him from each of my surviving children in equal poportions7 The house and Garden shall not be sold on any account8th Whoever of my beloved children may be in possession of the house shall keep it in good repair within and and all outside repairs to be paid for by the occupier and then deduct from the annual amount paid the brother and Sisters a portion so that each shall pay alike9th One half the Garden in front of the house during the term of the natural life of my daughter Eliza Trevithick be considered as belonging to this house to my eloved son Thomas Trevithick whom I make my executor I bequeath the lower half of the Garden in the front of Hia houaw, excepting the pathway for his own use and should he survivehis Sister Eliza Trevithick aforesaid he is to have possession of the house and all the Garden in front on payment to his Sister Mary Gilbert the sum of twenty shillings annuallly lawful coin of the realm and his sister Elizabeth and Nephew Wm Hunter the sums appointed for each of them aforesaid whose time will commnce from the time their coming to Pool afer my decease2nd The stones now laying at the back of this house with liberty to build for himself a Dwelling house on the said spot but to be so built as not to inconvenience this house as now standing that may be done immediately.3rd If my beloved son Thomas Trevithick and his Sister Elizabeth Trevithick shall at any time agree for Thomas to occupy the house she will receive from him thirty shillings annually and he be subject to all and same conditions as Eliz will be while she continue to occupy the said house4th the poors rates to be paid by the occupier at the time being.5 And if Thomas and Eliza should agree for Thomas to occupy the house Eliza shall be at liberty to build at the back of this house a delling house for herself on the same conditions as offered to her brother Thomas. To my beloved son Thomas Trevithick I bequeath my small bedstead and also so much of my clothes as he can wear the aforesaid remainder to be divided between him and his sister Mary Gilbert, my large Bible I bequeath to my Daughter Eliza Trevithick for her own use and purposes the money from the Club to be applied toward defraying the expenses of my funeral after which the remainder if any to pay for the deed of this house and if my Son Thomas will reverse the deed he is at liberty to do so and enjoy all advantages of the reversion. The proving the Will shall be paid for by my son Thomas Trevithick and my Daughter Mary Gilbert and Eliza Trevithick especially contributing toward the said expenses if there is any money left of the Clujb money that is to be applied for the said purpose all expenses to be paid before anyone apply any money to their own use.
