The following is from The Fail/Faile/Fails Family Trail by Welton Reul Fail: At the November Court, 1733, Edgecombe County, North Carolina, Richard Killingsworth lists the goods and chattels of John Fail: "The list of all John Fail's goods and chattels There is one bed and dubel blanket $ 1 rugg, 1 pot and pot hooks, 1 frying pann, 1 skillet, 1 narrow axe and broad axe and a parcel of Joyners Tools, one chest and a lock and key, Roundlet and 1 gun,1 grindstone and a parcel of timbers tied & one table frame put together, one mare, one saddle, one unmarked heiffer and his wearing cloaths. Richard R. Killingsworth, Edgecombe Precinct. November court 1733 - - - -The above inventory of the Estate of John Fail was exhited by Richard Killingworth, Extor. thereof on his oath which was ordreed to be recorded." - -Test. A.B. Foster, Clerk. "No reference is made to any family of John Fail; I therefore presume that he had none. In Edgecombe Precinct, North Carolina, 15 May 1733, Thomas Fail sold 200 acres of land to Richard Killingsworth. I do not know when nor how he acquired this land, as I have found no records of the acquisition.I do not have documented proof that John and Thomas Fail mentioned above are the sons of John Fail of Virginia. However, I feel stronly they are his sons since John Fail in Edgecombe County, North Carolina had capenter tools (youners tools) and was obviouly to make of furniture, and since carpenter tools had been willed to John and Thomas Fail by their father in the John Fail Will of 1712, Henrico County, Virginia. However, no trace was found of John and Thomas Fail in Virginia after 1712. I have discussed this with professional genealogists and they agree that it is logical to presume that John and Thomas Fail of Edgecombe County, North Carolina are the sons listed in John Fail's Will in Henrico County, Virginia in 1712. I have found no further trace of John and Thomas Fail in Virginia.In 1901, Dr. Warren Dexter Fales of Washington, D.C. was in correspondence with James Faile of Taxahaw, South Carolina who, according to Dr. Fales "has quite complete information about his line."James Thomas Faile gave the names and dates of birth of Thomas Fail's children as follows:Thomas Fail Issue:Mary Fail b 20 February 1737 Martha Fail 9 November 1739 Elizabeth Fail 12 May 1742 John Fail 7 February 1743 Thomas Fail 3 May 1745 Ann Fail 3 April 1747 Lewis Fail 5 February 1751 William Fail 19 April 1759 Dickson Fail 5 September 1760 "From an old paper compiled and left in a trunk, members of a Fail Family in Taxahaw, South Carolina. "No pictures are available of Thomas Fail, therefore I am left to wonder if he was tall or short; what was the color of his eyes; was be bald? He acquired considerable land in Edgecombe and Johnston Counties, North Carolina from 1733 to 1770. I know he was well respected in his community as he was called on many times to provide security for the settlement of estates, to serve as executor of wills and as a grand juror for the County Court. Thomas Fail apparently moved from Edgecombe County, North Carolina between 11 August 1740 when he sold 320 acres of land in Edgecome County, North Carolina to John Jenkins and 21 May 1741 when he petitioned the State of North Carolina, for 200acres of land in Craven County, North Carolina, the county from which Johnston County was created in 1746. Then, Thomas Fail removed from Johnston County, North Carolina about 1770, to Lancaster District, South Carolina where he started acquiring land. Beginning with the year 1770, he acquired land grants from South Carolina totaling 1000 acres, the last grant being received in 1772.By 1777, Thomas Fail was deceased, as his son John Fail of Johnston County, North Carolina sold 150 acres of Thomas Fail's estate in South Carolina to William Fail, also son of Thomas Fail. I have not found a record of the distribution of the estate of Thomas Fail. In late 1795 or early 1796 "John Fail, Administrator, returned into Johnston County, North Carolina as account of sales of the Estate of Thomas Fail, deceased, amounting to L48-5 which was ordered to be filed." "On March 27, 1797, Mary Johnson, daughter of the late Thomas Faile of Camden District, S.C. gave a Power of Attorney to her brother Thomas Faile of Hancock County, Georgia to collect her share of her father's estate."
