  2. 2.0 2.1 2.2 2.3 Will, Codicil and Probate of Simeon Ricker.

    In the name of God Amen. I SIMEON RICKER of Lebanon in the county of York Yeoman, being weak in body, but of sound mind, memory and understanding (praised be god for it) and considering the certainty of death and the uncertainty of the time thereof, and to the end I may be the better prepared to leave this world, whenever I shall please God to call me hence, do therefore make and declare this my last will and testament in manner following (that is to say)

    First: I give and bequeath unto my son JESSE RICKER the use and income of twenty five acres of land being a part of the farm on which I now live, and in range ten No. 7 and range eleven No. 7 of lots in said Lebanon joining land of WENTWORTH HAYES, for and during said Jesses natural life and after his decease I give and bequeath the above described parcels of land to EDMUND RICKER son of said Jesse and to said EDMUNDs heirs and assigns forever in fee simple. I also will that my son JESSE shall have the privilege of occupying and living in the westerly end of my swelling house being the half of said dwelling house in which the said JESSE now lives together with half the cellar and the west half of the door yard, and the westerly half of my barn together with the privilege of a road for young to and from said barn to the lands above described at any and all times, said JESSE to hold and occupy house and barn the one half of each only together with the privileges aforesaid for and during his natural life and after his decease; then my will is that said EDMUND shall have and hold said half of the house and barn to himself his heirs and assigns forever together with the privileges aforesaid. Also, said JESSE and EDMUND is to have the privilege of going from said land above described to the new road at any and all times with _eams &c.

    Second. I give and bequeath to my daughter MERCY RICKER for and during her natural life and after her decease I will to ALEXANDER M. RICKER and WINSLOW W. RICKER sons of said Mercy their heirs and assigns the following parcels of land viz twelve and a half acres of land in range ten No. 6, and twelve and a half acres in range eleven No. 7 and joining land of EBENEZER JONES Jr. I also will that said Mercy shall have and occupy the easterly half of my swelling house and the easterly half of my barn together with half the door yard and half the barn yard during her natural life, permitting her sister ABIGAIL RICKER to have a home in said easterly half of my dwelling house at any and all times so long as said Abigail shall remain single, and after the decease of said MERCY RICKER, then I will said easterly half of the house and barn together with the easterly half of the door yard and barn yard to said ALEXANDER M. and said WINSLOW W. their heirs and assigns forever.

    Third. I further will that all and the residue of my real estate (saving that above described and willed as above) shall be divided equally between my children hereinafter named viz. SALLY ESTES wife of George ESTES, MOLLEY RICKER widow of NATHANIEL RICKER late of said Lebanon, ABIGAIL RICKER aforesaid, HANNAH HOOPER wife of JOHN HOOPER of Tuftonborough N.H. PHEBE HORSOM wife of OLIVER HORSOM of said Lebanon, EUNICE DOWNS wife of REUBEN DOWNS, she is now at Dover, N.H., JACOB RICKER of Moultonborough, DORCAS DOWNS wife of MARK DOWNS and EDMUND RICKER and in case of his death to his heirs of his body.

    The last above named children of mine are to share and share alike in all the residue of my real estate wherever it may be found after paying my debts if there shall be any out standing and my funeral charges.

    Fourthly. I the said SIMEON RICKER hereby constitute and appoint INCREASE S. KIMBALL of Lebanon aforesaid Esq. sole executor of this my last will and testament.

    Codicil
    I SIMEON RICKER of Lebanon in the County of York and State of Maine Yeoman, being weak in body but sound mind and memory blessed by God for the same do hereby make, declare and publish this my last will and testament.

    1st. I hereby constitute INCREASE S. KIMBALL of said Lebanon and make and appoint him Executor of this my last will and testament. After payment of my just debts and charges, I dispose of my estate as follows: I give and devise to my daughter MERCY RICKER a part of lot in range 10, No. 6, together with the easterly half of my dwelling house and the easterly half of my barn lying by the side of EBEN JONES JR. land to have, hold and occupy for and during her natural life, also twelve and a half acres of land in range 11, No. 7, adjoining land of EBENEZER JONES JR. for and during her natural life and after her the said MERCYs death my will is and I hereby give and bequeath said real estate above described to the two sons of said Mercy, ALEXANDER MONROE and WINSLOW W. RICKER to have and to hold in fee simple to them and their heirs and assigns forever as named in my will to which this is a codicil. I give and devise all other my messuages, lands and tenements whethersoever situated unto my son JESSE RICKER to use and occupy the same for and during his natural life and after his death my will is, and I hereby give all the real estate which I own lying between the lots I have given to the two sons of my daughter Mercy and that I gave EDUMND RICKER son of JESSE RICKER in my will which I made and published last September the fifteenth day wherein I made said KIMBALL executor; to LUCY ANN RICKER, DANIEL RICKER and TAMSON RICKER children of said JESSE to them in [ ] and their heirs and assigns forever.

    And I hereby revoke so much of my last will and testament published by me as aforesaid wherein I give a part of my real estate to SALLY ESTES wife of GEORGE ESTES, JACOB RICKER, MOLLY RICKER widow of the late NATHANIEL RICKER, HANNAH HOOPER, EDMUND RICKER, PHEBE HORSOM, ABIGAIL RICKER, EUNICE DOWNS and DORCAS DOWNS wife of MARK DOWNS, all these children last enumerated I give fifty cents each when they shall call for the same on my executor instead of the land I willed them in my will of the date above mentioned. Further, my will is that my daughter MERCY RICKER shall have all the arrears of the Pension that may be due me from the United States for revolutionary services at my death and dispose of the same as she may think proper after paying for drawing the same and expence of my last sickness.

    In witness whereof I SIMEON RICKER (the testator) have to this my codicil being a part of my last will and testament set my hand and seal this seventeenth day of January A.D. 1835.

    State of Maine. At a Court of Probate held at York within and for the County of York, on the fourth day of May in the year of our Lord one thousand eight hundred and thirty five: Whereas the instruments hereunto annexed, have been presented to me, as the last will and testament and codicil thereto, of SIMEON RICKER late of Lebanon in said county, yeoman, deceased, by INCREASE S. KIMBALL the executor there named, and due notice thereof, and of the time and place appointed by me for taking the probate of the same; has been given to the heirs of said deceased, and to all persons interested therein, by an advertisement in the Kennebunk Gazette for three weeks successively, pursuant to the order of said court, and whereas it is proved to me by the testimony of PETER JONES, a subscribing witness to said codicil, and of HAWLEY A. KEAY one of the subscribing witnesses to said will (there being no objection made to the probate thereof) that the said instrument was signed and published by the said SIMEON as his last will and testament; and that at the time of executing the same, the said SIMEON was of sane mind; and it further appearing to me, that the same was attested in his presence by three credible witnesses, whose named are there unto subscribed: I do therefore by virtue of the power and authority given to me, in and by the laws of the state aforesaid, hereby approve and allow of the said Instruments as the last will and testament of said deceased, and order that the same be recorded, and that DAVID JONES, THOMAS WENTWORTH and HAWLEY A. KEAY all of Lebanon in said county, be a committee to appraise, upon oath, all the estate of which the said deceased died seized and possessed in said County of York. WM. A. HAYES, Judge.

    William A. Hayes Judge of the Court of Probate within and forsaid County To INCREASE S. KIMBALL of Lebanon in said County, Greeting:

    Whereas, at a Court of Probate this day held at York within and for said county of York, the last will and testament and codicil thereto of SIMEON RICKER late of Lebanon in said County, deceased, has been proved, approved and allowed, a copy of which and of the probate thereof is hereunto annexed. And whereas you are therein named and appointed by the testator, Executor of said will, and have taken upon you that trust; and given bond as the law directs. I do therefore, by virtue of the power and authority given to me by the laws of said state, commit unto you the execution of the same and the administration of the estate of said deceased, whereof he died seized and possessed; and you are to return upon oat a true and perfect Inventory of said estate into the Probate Office in said County within three months, and also to render a just and true account of your proceedings upon oath within one year from the date hereof, and in all things according to law, and in fulfillment of the trust reposed in you, faithfully to discharge the duties of an Executor of said will. You are also hereby ordered and directed to make known your appointment as aforesaid by causing notifications thereof to be posted up in some public place in the town where the said deceased last dwelt and in the two next adjoining towns within three months from the date hereof. In testimony whereof, I have hereunto set my hand and seal of office, this fourth day of May in the year of our Lord one thousand eight hundred and thirty five, Wm. A. Hayes, Judge.
