Will Transcript
- I Samuel Weeks of the County of Shenandoah and State of Virginia, do hereby make my last Will and Testament in manner and form following, in the name of God amen, That is to say ~
- 1st I give and bequeath unto my beloved wife That is after all my just debts and funeral expenses are paid Elizabeth one third part of my entire estate, that is real and movebly, or the one third out of the entire amount arising out of the sale of the real and personal estate of which I die seized, being I direct my Executor to make public sales of all the aforesaid estate both real and personal within sixty days after my decease and I consider that my real estate under present circumstances to be worth eight hundred dollars, should the same be offered at public sale as herein directed and fall short of the sum of eight hundred dollars that is within fifty dollars, then my Executor is to sell the same at private sale, to the best advantage within a reasonable time after my decease, further I give to my aforesaid Wife Elizabeth one cow such as she may choose out of my stock of cattle at my decease of which I die seized also ont good bed, Tables, bureau an Carpeting, and further I direst my Executors after paying to the ____ the grain due the same, to give or furnish my wife Elizabeth as much grain as may be sufficient for her the our children until harvest not occuring, and should the mill not, be sold during that time she is draw her due proportion out of the same as long as unsold.
- Further I do not consider myself indebted to the firm But think there is balance due me out of the mill of Ninety five bushels of wheat and that amount will place me even with my partners.
- I further direct my Executor tat he shall keep a guardian eyes on the raising of my children and place the boys as they become mature age to such trades as they may choose that may be honest and honourable and after paying my wife one third out of my Estate the balance he is to place at interest and pay to my children as the[y] become of age whose names are Theodore, James, William Henry & Margaret Ann the same to be equally divided between the aforesaid heirs.
- Lastly I do hereby constitute and appoint my friend Joseph Borden executor of this my last Will and Testament surely revoking all other or former wills by me heretofore made.
- In witness whereof I have hereunto set my hand and affixed my seal this 21st day of October in the year of our Lord one thousand eight Hundred and thirty four.

- Signed sealed published and declared by Samuel Weeks as and for his last Will and Testament in the presence & hearing of us who at his request and in his presence have subscribed our names as witnesses

- At a Court held for the County of Shenandoah on Monday the 10th day of November 1834.
- This the last Will and Testament of Samuel Weeks dec'd was produced into Court & proven by the oaths of John Snarr and Benjamin Stronck witnesses thereto and ordered to be recorded. And on Motion of Joseph Borden the Executor therein named, Who was sworn and entered into bond with Andrew Bushong and Jacob Capp as his securities in the penalty of three thousand dollars conditioned according to Law Certificate for obtaining a probat of said Will in due form is granted him.
