Case 28928 Samuel Ward 1691.
[Note: the writing in this will is very hard to read, possibly generating three persistent errors about children of this man. Unfortunately, although the reverse side of the will says it was recorded, the docket for this case shows no recorded documents (here), nor can one be found by paging through the books anywhere near the date the will was processed in court. It would be nice to have a second opinion on the interpretation. Searching has yet to locate a transcription online. Extensive additions have been added to bring out some of these issues.] Will of Samuel Ward (testator not named in will), dated Ipswich 29 [Julie?] 1689, proved 22 Apr 1691, "whereas the Governor and Counsill have ordered me on an expedition to Canada", names wife Sarah ["all that which I gave her at my day of mariag", "having given me a Living Child by her", my Negroe [Ceser?] during my daughters Lieff]; John Tuttell and daughter Martha [see elaboration below]; daughter Marie doliver of marblehead; stock for use of widow "after my honored father Bradstreet is paid" then divided among children; son Samuell Ward [he paying surviving children of my daughter Abigall Hiens; children of my daughter Remem'br Wilson; daughter Mercy] but if he dies without a male eaier then divided among other children; daughter Mercy [see elaboration below]. Wife Sarah to be executrix. 12 Mar 1690/91: Inventory of Major Samuel Ward deceased: £209-18-03, by John Dane, Richard ffalker.
[Regarding the phrase involving "son John" it appears to say: "for my goods now in boston or Charlstown which my father ward Left me my will is that my son John Tuttell [chod?shall?] have six pounds in or as mony it being a leggasie which my daughter martha had given her from her grandfather". John Tuttell could easily be misinterpreted as John Kettell and may have contributed to misunderstandings about daughter Elizabeth, for which numous refutations are documented on her talk page. Further, other people (e.g., Source:Sumner, Edith Bartlett. Descendants of Thomas Farr of Harpswell, Maine and Ninety Allied Families), p. 305) simply say the will names a son John, even though no such son appears in other wills (i.e., Moses Maverick) and deeds that names Samuel's children. Considerations of Abigail's age means that having John as a son would imply Samuel had an earlier wife, of whom there was no record, and his age at death even challenges the ability of Samuel to be his father (Samuel baptized 1638 and John born about 1653, so if baptism soon after birth, Samuel would be only 15).]
[The bequest to Mercy is followed by "(on[e] of the best fether beds... if she die befor maried". Secondary literature routinely shows daughter Mercy as marrying a Mr. Cane. It is believed that the first word has possibly been misread as "Con" leading to persistent assertions that she married a Mr. Cane? Combined with the comments about 2nd wife having a living child, and the indication that Mercy is unmarried, Mercy appears to be a child of the 2nd wife (she is not named in Moses Maverick's will). Further, if we removed the son John as outlined above, then we remove the unnamed daughter baptized with John. Mercy is not named in Moses Maverick's will, nor is she named in the deeds selling Samuel's Charlestown farm, so apparently soon died?]

29 Jul 1719: Bond of Mary Walters [sic, probably Watters?] of Marblehead widow & Martha Tuttle of Ipswich widow being daughters of the testator as administrators with will annexed of the late Maj'r: Sam'll Ward late of Ipswich (his Eeec'x being also dead) especially regarding a farm in Charlestown that remains unadministered.

Vol.31, p. 304 1 Mar 1720: Subscribers children and grandchildren of Samuel Ward late of Ipswich deceased for £153 convey to Nathaniel Tuffts of Charlestown about 15 acres in Charlestown. Vol. 21, p. 332: 11 May 1720: Indenture between Mary Waters of Marblehead widow, Martha tuttle of Ipswich widow both daughters of Samuel Ward late of Ipswich deceased, John Curtis of Marblehead mariner and Margaret his wife, Joseph Dolliber of Marblehead mariner and Mary his wife, Hannah Waters of Marblehead Spinster, William Gross of Marblehead mariner and Rebecca his wife, Mark Haskal of Hull husbandman and Martha his wife, Nathaniel Warner of Ipswich husbandman and Mary his wife, William Hascal of Hull Shipwright and Abigail his wife all grand children of said Samuel Ward all on one part, and James Miller of Charlestown yeoman on the other for £168 8 acres of meadow and upland. Sarah Ward, Abigail Ward, Remember Tuttle, William tuttle , Sarah Tuttle and Susannah Tuttle grandchildren of said Samuel Ward to get their dividend when of age or married by giving quitclaim.
