Will: Spotsylvania County Court 4th of February 1728/9 Winifrid Tillary produced Samuell Tillarys Last Will and Testament which was proved by Oath of George Carter and sworn to p the said Winifrid, Executrix, as the Law enjoyns, was admitted to record and certificate granted the said Executrix for obtaining letters of probate in due form, and Ordered that Robert King, Daniel Brown, John Naul, & Abell Stears or any three of them (being first sworn before Majestrate of this County) do appraise all such of the said Sammuell Tillarys deced Estate as shall be produced & shewn the p the said Executrix & make return their proceedings to the next court.

Will: Winifrid Tillary, Widdow, acknowledged her Deed of Gift to her Son, John Tillary, and her Daughter, Mary Tillary, for good & Chattles which admitted & at ye request of said Winifred in behalfe of her two children the same was ordered to be recorded.

From "A Biographical Sketch of Patriot John Tillery":


Samuel Tillery died in St Georges Parish, Spotsylvania County, Virginia in April 1728 His will left everything to his wife Winefred (Winifred) and when she remarried in 1729 she transferred all of the property to her children John and Mary Tillery.
Winefred married David Kincade who had fled Scotland after the unsuccessful uprising of 1715. They moved with the small children John and Mary west to Greenbriar County, VA.
