14 Nov 1827, Greene County, TN Court Records: John C. Hale and Sarah his wife formerly Sarah Templen and Hannah Templin heirs at law of Samuel Templin dec'd. vs. John Cox and Prescilla his wife formerly Priscilla Templin, James Dukins and John McAlister. The Bill of revina? filed in this cause not having been answered ~ on motion it is considered that this cause be reviewed in the name of Henry R. W. Hill and William R. McAlister administrators with the will annexed of John McAlister dec'd. it applaning that the subpoena to answer issued in this cause had been served on the said administrators, and court adjourned untill court in course untill which time all Matters and things in the same depending and undetermined and continued. 23 May 1828, Greene County, TN Court Records: the minutes of yesterday's proceedings were read and signed John C. Hale and Sarah his wife formerly Sarah Templin, and Hannah Templin heirs at Law of Samuel Templin Dec'd. complainants vs. John Cox and Prescilla his wife formerly Priscilla Templin, James Deekens and Henry R.W. Hill and William K. McAlister administrators with the will of John McAlister Dec'd. This cause having come on to be finally heard and determined this twenty second day of May 1827 before the Honorable Nathan Green Chancellor &c. and the Bill of Complainants being read and the answers of the Defendants and the Depositions of sundry witnesses taken in this cause as well on the part of the complainants as of the Defendants and argument by counsel on both sides having been heard and it appearing to the satisfaction of the Court that the complainants are entitled to have an account taken in the case, and also a final Decree for whatever sums shall appears to be due to the complainants upon the coming in of the clerk and Masters Pyeant? either by the Defendants administrators of the estate of Samuel Templin dec'd. are as Guardian of the minor heirs of the said Samuel Templin, that is to say, of the complainants Sarah and Hannah ~ it is therefore ordered, adjudged and decreed by the court that in this case the clerk and master do take an account and report to this Court at the next term thereof 1st. what sums of money came to the hands of the administrators of the Estate of Samuel Templin dec'd. In doing which the clerk and Master will charge said administrators separately with whatever sums they received with Interest on the sums from the time they received it up to the time of taking said account. 2nd. The Clerk and Master shall state what sums said administrators have expended in the due administration of said Estate, in doing which he shall credit them by such sums so paid with interest on said sums from the time paid up to the time of taking said account. 3rd. The Clark, and Master shall state what sums of money have come on might have come to the hands of the Defendant John Cox as Guardian of complainants Hannah and Sarah with the Interest which has accrued on the same, in doing which the clerk and master shall state the account, and at the end of last year, from the time such sum or sums of money, came to the hands of such Guardian and the Balance of principal and Interest in the hands of such Guardian at the end of each year, shall be principal, and bean? interest for the next succeeding year, throughout the time such money shall have been in his hands. 4th. The Clerk and Master shall allow the Defendant John Cox and wife out of the share of the estate of Samuel Templin deceased which belonged to his son Samuel Templin also deceased a reasonable sum for the boarding the said Samuel Templin junr. from the time of his birth up to the time of the Death of said Samuel [Templin] Junr. and also for his schooling and clothing and expenses for him in his skckness. 5th. The Clerk and Master shall state the amount necessarily expended in and about repairs on the lot and Tan yard belonging to the estate of said Samuel Templin deceased from the time of his death untill it came to the hands of the complainants. 6th. The Clerk and Master shall enquire and report, whether at the death of Samuel Templin he was indebted any sum, and if any sum then how much to the Grandfather of the complainants Hannah and Sarah, and also whether the said Grandfather at the said complainants by will or otherwise, directed said sums of money to be paid to said complainants his Grand children. 7th. Th Clerk and Master shall enquire what was the respective ages of the complainants Hannah and Sarah at the time of the Death of their father Samuel Templin, and if he shall ascertain that wither of them were at that time under the age of ten years, then and in that case he shall state a reasonable Allowance for their Cloathing and Boarding each untill they attained the age of ten years, but after the age of ten, the Clerk and Master shall now allow anything for the Boarding and ordinary wearing aparrel of said complainants but he shall allow for their schooling and Boarding while at school, and also for any articles of Dress furnished, them aside from their ordinary Cloathing ~ as also any articles of value furnished them, if any such, as saddles, Bridles, fc. and bureaus if any such was furnished. In taking the account as hereby ordered the Clerk and Master is not to allow the children of John Cox and wife any shares of the real or personal estate of Samuel Templin the yunger their half Brother as contended for in the answer of Defendants Cox and wife ~ as it appears to the satisfaction of the court that said Children of Cox and wife under the circumstances of this case are not entitled by law to any share in the estate of the Brother of the half Blood, as said Estate came to him wholly by Descent from his father Samuel Templin and the clerk and master in taking the account shall hear proof and examine the parties by Interrgatory if necessary.
