Will of John Myers

Dated 22 Feb 1822 - Proved 20 Oct 1823

(Some punctuation added to ease reading)

In the name of God, Amen! I, John Myers, Sen'r., of Earl township in the County of Lancaster & State of Pennsylvania, being in perfect health of body and of sound mind, memory & understanding (blessed to God for the same). But considering the uncertainty of this transitory life, do make & publish this, my last will and testament in manner following to wit: Principally and first of all I commend my soul into the hands of God who gave it, and my body to the earth to be buried in a decent & Christian like manner at the discretion of my executors hereafter named. And as to such worldly estate wherewith it hath pleased God to bless me in this life, I give & dispose of the same in the following manner to wit:

Item: It is my will & I hereby order & direct that my just debts and funeral expences shall be paid out of my estate as soon as conveniently can be after my decease.

Item: I give & bequeath unto my my beloved wife, Susanna, all the linen & woolen cloth and yarn on hand at my death, one cow (her choice), two hogs, as much of my household & kitchen furniture as she shall choose to take together with the right & privilege she has in & by a certain bond of performance in our possession, I allow to be in lieu and stead of her dower at common law.

Item: I give & bequeath unto my three youngest children, namely, Abraham, Susanna and Isaac, and their heirs, each the sum or legacy of five hundred pounds lawful money of the state of Pennsylvania, to be paid unto them out of the first monies comming [sic] due to my estate (after my just debts are paid), beginning with the eldest and soon to the youngest, and in case of death of any of my said children in their minority, unmarried and without issue, Then I order & direct that the legacy or share of such child or children so dying shall go to & be considered as part of the residue of my estate.

Item: Whereas in & by a certain bond of performance there remains the sum of five hundred pounds, payable by my son, Henry, immediately after my death and after the death of my said wife, Susanna, or after the death of the longest liver of either, which said five hundred pounds and all the residue & remainder of my estate of what kind or nature soever the same may be. I give & bequeath the same unto my eight children, namely: John, David, Samuel, Jacob, Christian, Abraham, Susanna & Isaac & their heirs, share & share alike.

Item: The reason why I excluded my three sons Peter, George & Henry from any inheritance in this, my last will, is because I advanced them with their full shares & portions in my estate by conveying lands unto them in my lifetime, and also my five sons, John, David, Samuel, Jacob & Christian, having each of them heretofore received of me the sum of five hundred pounds which will equalize them with the legacies of my three youngest children herein before devised unto them.

Item: It is my will & I do hereby order and direct that all & every such sum or sums of money and effects by me paid, advanced & delivered to my children or some of them, for & towards their advancements in this world as the same are entered & charged against them or may be charged against them hereafter in a book of accounts by me kept for that purpose, shall be deemed as so much in part of the respective shares in my estate.

And Lastly, I nominate, constitute & appoint my dear sons Peter Myers of Leacock township, George Myers of Earl township and David Myers of Manheim Township, all of the County of Lancaster, to be the executors of this my last will, hereby revoking all other will, legacies & bequests by me heretofore made, and declaring this & no other to be my last will and testament. In witness whereoff I, the said John Myers, Senr., have hereunto set my hand & seal this twenty second day of February Anno Domini one thousand eight hundred and twenty two.
