- Will of Samuel Lusk Sr.
- Recorded Jan. 24, 1824
- Written September 10, 1810 Maury Co. Tn.
- Added to it, January 15, 1816.
- In the name of God Amen, I Samuel Lusk Sr. of the County of Maury and State of Tennessee. In usual health and in sound mind, knowing the shortness and uncertainty of time and the certainty of approaching death, do make this my Last Will and testament, Soleumly dissolving and giving up my Soul to God, and my body to the dust whenever it shall be his will to call me hence, and I order that my body be decently buried and all my lawful debts paid. the remaining property to be disposed of with manner following.
- To my beloved wife, Margaret I give and bequeath one, one Negro Woman named Eader (or Eades) and at her death to dispose of her the said Negro as she pleases, and also all my household furniture to her use while she lives and to be at her disposal at her death. and also the remaining part of my property to be to her use while she lives, and the remaining part of my Negroes to be to her use while she lives but at her death the property that is not left to her disposal, I do bequeath in the following manner, to my beloved daughter Elander, I give and bequeath one Negro girl by the name of Dorcus, and to my beloved son James, I do give and bequeath one Negro Boy by the name of Sike, and to my beloved son Samuel, I do give and bequeath one Negro Boy by the name of Jacob, and I do give and bequeath unto my beloved daughter Margaret, one Negro girl by the name of Milly.
- To my beloved Son Robert, I do give and bequeath one Negro nan by the name of Hyle, and to my beloved grandson John McGill, I do give and bequeath one Negro Boy by the name of Jesse. But if he the said John McGill should die without an lawful heir, the said Negro shall return to my heirs again.
- And I further give and bequeath to each of the legatees above named, except my grandson John McGill. one equal moiety (?) of all my property not heretofore devised, after my wife's decease and I also will at the death of the above named legatees that the above named Negroes shall be given to the heirs of their bodies. :And I do hereby constitute and appoint my beloved sons James and Samuel and Robert my executors, and I hereby give them full power and authority to Execute this my last will and testament and I do hereby annul all former wills and testaments and declare this to be my last will and testament, in full force and vertue.

- Know all whom it may concern, that I Samuel Lusk of the State of Tennessee and Maury County, did make and sign a certain Deed or instrument of writing as my last will and testament bearing date the tenth day of September in the year of our Lord one thousand eight hundred and ten, from changes that has since taken place in my property. I am induced to make the following alterations by this Codicil.
- 1st I did bequeath unto my beloved wife Margaret a certain Negro woman named Adah during her life and to he at her disposal at her death, but if she should die intestate (instant?) it is my will that said Negro woman be vested in my son Robert and his heirs forever.
- 2nd In said will I did give and bequeath unto my daughter Elenor Whiteside of South Carolina and York district, one Negro girl named Dorcus and unto my daughter Margaret I did begueath one Negro girl named Milly, both these Negroes is since dead. I therefore by these presents do disannul and make void that part of my will, which bequeaths said Negroes, and instead thereof I do give and bequeath unto my daughter Elenor Whiteside one Negro Boy named Barren, upon condition that she be a residenter in the State and County that I now live in, in the space of two years after the above will becomes in force but if she should not be a residenter in the said State and County in the above term of two years, then said Negro Boy shall be sold according to her directions by my Executors to the highest among the heirs of my body and the monies arising from such sale be paid to her lawful heirs. and I do farther give and bequeath unto my daughter Margaret one Negro girl named Anna, and I do ordain and confirm this annexed codicil as a part of my will, and to be observed and acted upon as such by my Executors and I confirm every other part of my will, except the parts altered and disannuled by this present codicil.
