    HOWEVER: The will was not probated within the statutory 40 daysfollowing the testator's death, and was therefore ruled of no effect orforce in passing on lands by inheritance. Everything then went toMordecai as eldest son and heir. Mordecai released Edward's intendedland back to him by quitclaim.
