- Vol. 2 - John Sinclair vs. Alexander--O. S. 324; N. S. 116--Bill, March, 1808. Gerrard Alexander, son of Robert Alexander, Sr., acquired 100 acres in now Jefferson County from John Harding, and on 11th November, 1752, obtained patent from Fairfax for 340 acres. And on 1st September, 1753, Gerrard obtained patent from Fairfax for 863 acres. Garrard obtained act of Assembly to dock entail upon him by his father of tract in Fairfax and to settle in lieu thereof the 863 acres. Gerrard died, testate, 9th August, 1760, eldest son Robert. Gerrard, Jr., in 1778 conveyed to Alexander Henderson, who conveyed to orator in 1796. Defendants are, viz: Gerrard Alexander, Ashton Alexander; Elizabeth Lee, wife of Thos. Lee, deceased; Griffin Stith and Mary, his wife; ____ Washington, Sarah, his wife; Jane and Sidney Alexander, children and representatives of Gerrard Alexander, deceased, who was son of Gerrard Alexander. Will of Robert Alexander dated 28th April, 1735, of Stafford County. Wife, Anne; daughter, Ann Hooe; son, John; daughter, Parthenia Massie; son, Gerrard, island in Prince William called Hornes (Holmes's); daughter, Sarah Alexander, under 16, land adjoining Parthenia Massey. Test, Richard Todd, Jethro and Sarah Bunsplatt. Proved in Stafford County, 13th April, 1736. Act docking entail, 8th December, 1753. Signed by John Randolph, C. H. B(urgesses), John Robinson, speaker; Robt. Dinwiddie. Special verdict says Gerard died September, 1761, leaving heir-at-law Robert Alexander, who died, testate, will dated 9th January, 1793. Will of Robert Alexander of Fairfax. Wife, Margamme (Maryamne); sons, Robert, Walter. Land devised to testator by his brother George, who was entitled to land for services in Revolution. Lot near Georgetown that came by his wife. Sister Anne's children. Dated 9th January, 1793. Codicil, brother George had a child by Mary Robinson, who is poor and unprovided for. Dated 28th January, 1793. Recorded in Fairfax, 18th February, 1793. Special verdict says Robert died 10th January, 1793. Gerrard Alexander's will is dated 9th August, 1760. Will of Gerrard Alexander of Fairfax dated 9th August, 1760. Wife, Mary; sons, Robert, Philip, George, Gerrard; daughters, Nancy, Mary Anne. Recorded in Fairfax, 16th September, 1761.

In the name of God, amen, I Robert Alexander of the County of Fairfax and the State of Virginia being of sound mind and memory do make and appoint this my last Will and Testament, desiring that all former Wills by me made may be cancelled and have no effect. Impremis, I give to my wife Maryanne a full third of my whole Estate real and personal during her natural life. Item. I give to my son Robert & his heirs forever one half of the land which I formerly sold to the late Mr. John P. Custis and upon which I now live, and it is my desire that my wife shall allot the same to him and his Heirs, and I hope my son Robert will conduct himself to the satisfaction of his mother as to induce her to give him that moiety of the land upon which the dwelling house is build, but should his mother think him wantingin duty and Attention to her, I will and desire the said moiety may be given to my son Walter and his Heirs forever. Item. I give to my son Robert and his Heirs forever one half of the land between he North line 6 and north line 17 which I have or may recover to be laid off in such manner as may be most convenient and contiguous to each of my sons moiety of the land upon which I live. Item. I give to my son Robert and his Heirs forever all the land I am entitled to in the possession of Mr. Baldwin Dade lying near the town of Alexandria. Item. I give unto my son Robert and his Heirs forever all the land lying near Co. Charles Broadwaters which was willed & devised to me by my brother George as will more clearly appear by his last Will and Testament. Item. I give to my son Robert and his Heirs forever the Tract of land in Hampshire County which I purchased of John Pancake as appears by the Deed of said Pancake. Item. I give to my son Robert and his Heirs forever nine hundred and sixty acres of land in Montgomery County upon the waters of Piney river and paint Creek branches of the Kenhawa [sic, s/b Kanawha] which was granted by the Commonwealth to Nicholas Hannah assignee of William Whitcroft & which Deed was signed by Nicholas Hannah to William Ward of whom I purchased it. Item. I give to my son Robert and his Heirs forever the Tract of land I purchased of Benjamin Drago upon Tiger Valley, which will more fully appear form the documents and papers lodged in the land office and the Reg: Receil [?] now in the possession of [?] Charles Alexander. Item. i give to my son Robert and his heirs forever one half of all the land I have a right to upon Jacksons River in the County of Greenbrier which will appear more fully from the documents and papers in the land office & the Regs: receit in the possession of Mr. Charles Alexander. Item. I give to my son Robert and his Heirs forever one half of all my lands in Ketucka [sic, s/b Kentucky] Which I claim under the Will and Testament of my brother George who was entitled to the same for services in the Continental War. Item. I give to my son Robert and his Heirs forever a Lott of ground in George Town in the State of Maryland which I purchased of the late Mr. Henry Warren as appears from papers in my possession. Item. I give to my son Robert and his Heirs forever a tract of land near George Town in Montgomery County, Maryland which came by my wife. Item. I give to my son Robert and his Heirs forever one half of my slaves and personal Estate which is my desire that he shall possess the same upon hsi arrival to legal age. Item. I give to my son Walter and his Heirs forever all the rest and residue of my Estate both real and personal and should my son Robert claim the land which came by his mother as his right of inheritance, it is then my will and desire that all the tract of land I sold to Mr. Custis and am now possess off shall be my son Walters and his Heirs forever. Item. it is my desire and will if either of my sons Robert and Walter should die without lawful issue, but in case of both their deaths without lawfull issue, I will and desire that my whole estate real and personal shall descent and persee [?] equally between my brother Gerrard's and sister Ann's children and their Heirs forever. Lastly, I appoint as Executors of this my last Will and Testament my wife Maryanne, my sons Robert and Walter, Ashton Alexander, George Chapman Senr. and Fielding Lewis. In confirmation of the above I hereunto subscribe my name and affix my Seal this 9th day of January 1793.

Since signing the above Will and Testament I have recollected that my brother George had a child by Mary Robinson who is poor and unprovided, it is my Will and desire in case of the deaths of my two sons Robert and Walter without lawfull issue, that the said Child shall have out of my Estate, two hundred pounds V. [Virginia] Currency, but in case my sons live or either of them to come of age, then I desire that he or they pay to the said Child one hundred pounds V. [Virginia] currency as soon as it can be conveniently raised out of my Estate, it is further my desire at the expiration of six years to be computed from thsi date that my slave Stephen shall be liberated as a compensation for his faithfull services to me. I further desire that all claims which I have against Barton Davis may be relinquished, as he has paid great attention to me in my illness.
