Patrick Day of Salmon River Settlement in the County of Guysborough, Farmer, being of sound and disposing mind and memory, but weak in body and knowing that it's appointed unto all men once to die, and wishing to dispose of what worldly property the Almighty in his goodness has intrusted to me in this life I do make and ordain this my last Will and Testament that is to say I recommend my soul into the hands of Almighty God who gave it and my body I recommend to the Earth to be buried in decent Christian burial-land as touching my worldly Estate and property as aforesaid Thereby give and devise in manner following - First I request that all my just debts and financial expences shall be paid out of my personal Estate by my executor hereafter named as soon after my decease as possible.
Secondly I give and bequeath to my beloved wife Mary the western half of the farm or lot of land on which I now live for and during the full term of her natural life, and after the decease of my said wife Mary I give and bequeath the aforesaid Western half of the lot on which I live to my beloved daughter Ellen and to her heirs and assigns for ever. And I also give and bequeath to my said wife Mary all the stock and cattle of every description and all my farming utensils and implements of husbandry which may be upon or belong to my said farm at the time of my decease with power to dispose of the same as she may think proper.
Thirdly I give to my son Patrick Day the eastern half of the farm or lot on which I reside - to the use of the said Patrick Day his heirs and assigns for ever.
And lastly I do nominate constitute and appoint my son Thomas Day - executor of this my last Will and Testament. My said son Thomas and my sons James, John and my daughters Catherine Walsh, Bridget Day having all been provided for an had their shares in my life time.
In witness whereof I have herewith set my hand and affixed my seal at Salmon River this tenth day of March in the year of our Lord One thousand and eight hundred and sixty four.
