In the Matter of the Will of Oliver C. Perry.
Before J.E. Swain, Clerk.
Louise Sublette Perry, being duly sworn, says:
That Oliver C. Perry, late of said County, is dead, and having first made and published his last Will and Testament; and that Louise Sublette Perry is the Executor therein named.
Further that the said Oliver C. Perry left real and personal property consisting of real property valued at about $900.00 and household furniture and worth about $900.00 so far as can be ascertained at the date of this application, and that Louise Sublette Perry is the part entitled under said Will to the said property.

A paper purporting to be the Last Will and Testament of Oliver C. Perry, deceased, is exhibited before me, the undersigned Clerk of Court for said County, by Louise Sublette Perry, the executrix therein mentioned, and the due execution thereof by the said Oliver C. Perry by the oath and examination of Robert H. Hunt and Junius L. Allison, the subscribing witnesses thereto: who being duly sworn, doth depose and say, and each for himself deposeth and saith, that he and she is subscribing witness to the paper writing now shown him, purporting to be the Last Will and Testament of Oliver C. Perry that the said Oliver C. Perry in the presence of this deponent, subscribed his name at the end of said paper writing which now shown as aforesaid, and which bears date of the 8th day of July, 1937.
And the deponent further saith, that the said Oliver C. Perry the testator aforesaid, did at the time of subscribing his names aforesaid, declare the said paper writing so subscribed by him and exhibited, to be his Last Will and Testament, and this deponent did thereupon subscribe his name at the end of said will as an attesting witness thereto, and at the request and in the presence of the said testator. And this deponent further saith, that at the said time when the said testator subscribed his name to the said last Will aforesaid, and the the time of deponent’s subscribing his name as an attesting witness thereto, as aforesaid, the said Oliver C. Perry was of sound mind and memory, of full age to execute a will and was not under any restraint to the knowledge, information or belief of this deponent: And furthere these deponents say not.

Order of Probate
Upon due consideration of the foregoing proofs and examinations of Robert M. Hunt and Junius L. Allison, the subscribing witnesses to a paper writing purporting to be teh Last Will and Testament of Oliver C. Perry, deceased, late of Buncombe County, said will being dated the 8th day of July, 1937, the same being now offered for probate as teh Last Will and Testament of Oliver C. Perry, deceased.
It is considered, ordered and adjudged, that said paper writing and every part thereof is the Last Will and Testament of Oliver C. Perry and the same with the foregoing proofs and examinations of the subscribing witnesses thereto are ordered to be recorded and filed.
It is further ordered that upon Louise Sublette Perry, the Executrix therein named, qualifying as provided by law, Letters Testamentary be issued unto said Executrix.
Witness my hand this the 6 day of Nov., 1937.

I, Oliver C. Perry, of the aforesaid county and State, being of sound mind, but knowing the uncertainty of my earthly existence, do hereby make and declare this my last will and testament:
ITEM ONE. It is my desire that my wife, Louise Sublette Perry, if she be living at the time of my death - if not, my executor hereinafter named - shall give my body a decent burial, out of the first money which may come into her hands belonging to my estate.
ITEM TWO. I give, devise and bequeath all my personal, real and mixed property to my beloved wife, Louise Sublette Perry, to be hers absolutely, if she be living at the time of my death.
ITEM THREE. If my wife predeceases me, or if we die simultaneously, I give, devise and bequeath all my real, personal and mixed property to my daughter, Margaret Perry, to be hers unconditionally and in fee simple, provided she have issue capable of inheriting; if she does not have issue, the property is to be hers for life, and at her death it is to revert to my nearest blood relatives.
ITEM FOUR. And, whereas, my daughter, Margaret Perry, is about the age of 16, and will not be the full age of twenty-one years until the 8 day of July, 1942: Now, therefore, in case my wife predeceases me, my will and desire is that my sister-in-law, Florence Sublette (Kirksville, Mo.), be appointed guardian, and is hereby appointed and constituted guardian of my daughter, Margaret Perry, if my wife is not living at the time of my death; and the said guardian is to have and hold the custody of my daughter’s estate until the latter reaches the full age of twenty-one years. And it is my desire that my sister-in-law, Florence, take Margaret Perry - if my wife is not living at the time of my death - and rear, educate, and care for her, and use what money and property, that in the guardian’s discretion is necessary for the care and training of my daughter, Margaret Perry.
ITEM FIVE. I hereby appoint and constitute my wife, Louise Sublette Perry, my lawful executrix, if she is living at the time of my death. If she is not living at that time, I appoint and constitute my sister-in-law, Florence Sublette, my executrix, to execute this my last will and testament, according to the true intent and meaning of the same, and every part and clause thereof, hereby revoking and declaring void all other wills and testaments by me heretofore made.
In Witness Whereof, I, Oliver C. Perry, do hereunto set my hand and seal, this the 8 day of July, 1937.

Perry, late of said County, is dead, having made his last Will and Testament, which has been admitted to Probate (a true copy whereof is hereunto annexed), and Louise Sublette Perry the Executrix named therein, having qualifed as such according to law:
Now these are therefore to empower the said Executrix to enter in and upon all and singular the goods and chattels, the rights and credits of the said deceased, and the same to take into possession, wheresoever to be found, and all the just debts of said deceased to pay and satisfy: and the residue of said estate to distribute according to the directions of said Will.
