DEATH: WILL: Nicholas Yost; Starkey, Yates co., NY surname: Yost, Quigley, Knight submitted by Susan Austin ([email protected]) Source: Sampubco photocopy Yates co NY Will Book Vol. F page 728 Written: September 13 1858 Recorded: June 19 1860 Sept. 13, 1858 In the name of God Amen I Nicholas Yost of the town of Starkey in the County of Yates and State of New York of the age of seventy nine years and being of sound mind and memory Do make publish and declare this my last will and testament in manner following that is to say First I give and bequeath to my wife Patience Yost all my personal estate of every description whatever Second I give devise and bequeath to my wife Patience Yost all my real estate in the said town of Starkey in the County of Yates + State of New York containing about one hundred + twenty eight acres of land her natural life that she is that may be assessed on said farm during her life time + not incumber the same in any manner nor waste or destroy any timber thereon except what may be necessary for the use of said farm. Third that after the death of my wife Patience Yost I give and devise the said farm above mentioned to three of my children namely John D. Yost of the town of Thurston, Steuben County Elizabeth P. Knight wife of Cyrus B. Knight of the town of Canisteo in Steuben County and Nicholas J, Yost of the town of Starkey in Yates County aforesaid and that they shall jointly pay to my other children on taking possession of the said farm as follows To my son Abram Yost the sum of two hundred dollars ($200~) To my daughter Mary now the wife of Samuel Quigley of the State of Illinois one hundred dollars ($100~) To my son Jacob S. Yost's two boys Charles and John One hundred dollars each to be paid to them or their legal representatives. And lastly I hereby appoint my son John D. Yost Executor and my wife Patience Yost Executrix of this my last will and testament hereby revoking all former wills by me made. That they shall provide for my funeral pay all necessary expenses, all the debts against me, and charge the same to the estate which shall be equally bourn by all the heirs in the same proportion that they have received. In witness whereof I have hereunto set my hand and seal this thirteenth day of September in the year of our Lord one thousand eight hundred and fifty eight Nicholas Yost Witnessed by John D.
