Know ye that I NICHOLAS SMITH of Essex County do out of pure Love and Natural affection which I have and bear unto my Son FRANCIS SMITH do by these presents make over one Track of land to my said Son FRANCIS SMITH and to his heires forever, Begining at a Poplar tree in a line that parts me and JOHN GEORGE upon a Swamp side and so down the Run of the said Swamp to the CHURCH SPRING BRANCH thence up the said Branch to the CHURCH SPRING and so along the PATH from the CHURCH SPRING to the CHURCH thence down the ROAD to the WHITE MARSH BRIDGE and so down the said Swamp till it comes to the line between JAMES HIPKINS and me and along that line to a Corner tree in HIPKINS tobacco ground and along the line that parts HIPKINGs, JOHN GEORGE & me to a Mulberry tree thence to another Mulberry tree and so along a line to a poplar on the Swamp side the begining place the said Land contains four hundred acres the said land contains my Dwelling Plantation which I do except, I do acknowledge unto my loving Son FRANCIS SMITH the above tract of land unto him and his heirs forever. TO ALL CHRISTIAN PEOPLE to whome these presents shall come I NICHOLAS SMITH of the Parrish of Southfarnham in the County of Essex send Greeting.
Know ye that I the sd NICHOLAS SMITH as well for the Natural affection and fatherly love which I have unto my Beloved Son NICHOLAS SMITH as also for divers other causes have given and do fully and absolutely grant unto my said Son NICHOLAS SMITH & to his heirs and assigns forever one certain percel of land being in Southfarnham Parrish in the County of Essex & joining to the land I now live on containing Three hundred acres bounded begining at a Popler standing in my MILL SWAMP & runing thence North West along a line of marked trees Parting this land and the land of EDWARD BOMAR to a Corner red Oak parting this land & the land of WILLIAM DOBYNS deceased, thence North East to a Quarter North along the line parting this land & the land of DOBBYNS to another Corner red Oak parting this land & the land of JOHN CHEYNEY to a white Oak standing on the South side of JOHN CHEYNEYS SPRING BRANCH thence down the Branch until it comes into my MILL SWAMP thence up the MILL SWAMP to the begining with all & singular its Rights Buildings, Orchards, Pastures or any profits and heriditaments whatsoever belonging and all the Estate right of me the sd NICHOLAS SMITH To Have and to Hold the said Tract of land with the appurtenances to my sd Son NICHOLAS SMITH to the only proper use & behoof of him my said Son his heirs & assigns forever. [Vol. V (date), p 220; Meade, 1, pp. 324; Essex Records] Petsworth Vestry Book NICHOLAS SMITH, of Petsworth Parish, Gloucester County, Virginia, was a vestryman 13 Oct 1697, churchwarden in 1700. In 1714 he conveyed to his son Nicholas Smith, Jr., land in Essex County, purchased of Richard Cocke, and originally patented by Thomas Bowler, Esq.
Taken from the vestry-book is the following copy of an indenture: [PETSWORTH PARISH]
This Indenture, made ye 4th day of April, in ye twelfth year of our Sovereign William, King of England, Scotland, France, and Ireland, Defender of ye faith A. D. 1700, witnesseth, &c., &c. . . . . I, Nicholas Smith and William Miller, church-wardens of ye Parrish of Pettsoe, and County of Gloucester, Doe, in the name and behalfe of the vestry, sign and Deliver unto Mr. William Bernard, an Indenture for Richard Allen, the son of Richard Allen, according to an order of Vestry, and by the free consent of his Mother, Susanna Allen, we Doe Bind unto Mr. William Bernard ye above-named Richard, for to serve him, the said Bernard, his Heirs, Executors, or Assigns untill he comes to ye age of twenty and one years, and in all such service or imploy as he, ye said master, shall or will imploy him about, as also ye said master by this indenture promise, and oblige himself for to give unto the above Bound Richard Allen three years’ Schoolling, and he to be sent to school at ye years of twelfe or thereabouts, and ye said. master Doe consent and agree to and with Nicholas Smith and William Miller, church-wardens, for to finde and alow ye said Richard Allen sufficient aparell, meat, drink, washing, and lodging during ye said Tearm of time, and ye said master for to pay unto ye above Bound Richard Allen all such necessary allowances as is to his Due, according to the Custom of this Country. In wittness whereof ye Parties above have interchangeably sett their Hands and Seals yDay and year above written. Signed by MR. WILLIAM BERNARD. Signed, sealed, and delivered in the presence of us. HUGH MACKTYER, Clarke of ye Vestrey. CONQUEST WYATT. +++ He was a witness and grantor for a deed dated 12 August 1714
from Nicholas Smith, Gentlemand of Petsworth Parish, Gloucester County to his "beloved son Nicholas Smith, Jun" of South Farnham Parish, Essex County, conveying 500 acres of land "adjoining the plantation where my son now lives" (Essex county D.& W. Book 14, p.273).
