"Nicholas Merwin (WalterA, NicholasB, ThomasC, JohnD) was born at Clewer, Berkshire, and baptized in the adjacent parish of New Windsor, 30 November 1628. As Nicholas Merwin "of Iver, co. Buckingham,"' he married at Stanford in the Vale, Berkshire, 8 June 1652, Elizabeth Hatt [Parish registers of Stanford in the Vale, Berkshire, FHL microfilm 88,414]. Nicholas Merwin, baker, was buried at Iver, Buckinghamshire, 11 May 1705. Elizabeth Merwin, widow, baker, was buried there 19 May 1710.

In his will, dated 9 November 1702 with a codicil dated 15 November 1702, and proved 26 August 1706, he was called Nicholas Merwin 'the elder' to distinguish him from his son of the same name. At the time of his death he owned a copyhold cottage or tenement, presumably at Iver, which was then in possession of his son-in-law, Richard Cotton.

'Infirme in body but of sound mind and understanding,' Nicholas Merwin of Iver made bequests as follows:

… unto Elizabeth Merwin my loving wife all & every my goods & Chattels whatsoever (not herein after bequeathed) shee paying my debts & legacies herein after mentioned … unto Elizabeth Merwin wife of Nicholas Merwin my Sonne [£5] and unto Elizabetth Eddowes my daughter [£5] and unto Hannah Merwin my daughter [£40] and unto Thomas Langley and Jane his wife the Sume of [£5] And unto Elizabeth and Alice Eddowes my Grandaughters [£5] apeice and unto Henry Elizabeth & Hanah Langley my Grandchildren |£] apeice which legacies shall be paid by my Executrix (hereinafter named) within Six monthes after my decease … unto the said Nicholas Merwin and Thomas Langley their Executors & Administrators [£10] in Trust to dispose thereof … In the first place to pay and discharge the ffine & herryott and other Indent Charges payments which shall be due & payable upon my decease att the admittance of the next Tenant to my Coppyhold Cottage or Tenement in the occupation of Richard Cotton my Sonn in law upon the Trusts and purposes in a Surrender by me made or to be made of the same premisses for the purpose mentioned And after such payments made then to pay the remainder of the said [£10] unto the said Richard Cotton … on payment of the legacie herein before bequeathed unto the said Elizabeth Eddowes she and the said Elizabeth my wife shall mutually release each other under their hands It Seale of all demands whatsoever … to the said Nicholas Merwin Thomas Langley Elizabeth Eddowes & Hanah Merwin [£30] to be paid out of my personal Estate within three yeares after my decease or within six months of the decease of the said Elizabeth my wife which shall first happen … & for the severall trusts & purposes … placed out at [Interest] … & disposed att the discretion of the said trustees for the only benefit of all the Children of the said Mary Cotton which she now hath or shall hereafter have …

He appointed his wife Elizabeth executrix. Witnesses were William Nicholls, John Nicholls [his mark], and Leonard Bavin, all of whom also witnessed a codicil made evidently on the same date, giving £5 more to daughter Hanah Merwin. A codicil dated 15 November 1702, witnessed by Leonard Bavin and Susanna Pitcher, both of whom signed by mark, specified that the £30 put in trust for the children of daughter Mary Cotton might be used for Mary's benefit if the trustees deemed it necessary."[1]
