Will Transcript of Mungo Roy, written August 1st, 1758
In the name of God, Amen, I Mungo Roy of the County of Essex, do make this, my last will and testament in the manner following.
I give and devise unto my son, James Roy, all my land in Essex Co, also fourteen slaves named Ned, Judy, (Judy's daughter), Perry Bun, Cyrus, Lydy, Zofy, Moses, Prince, Charles, Tab, Mountain, Sarah, Chloe, and Judy's son Dick, to the said James Roy and the heirs of his body lawfully begotten forever and for the want of such heirs to my son Mungo Roy and the heirs of his body lawfully begotten forever. I give to my son James Roy all my stock of cattle, horses, (except Jackey), sheep and hogs with all tools and utensils of husbandry that shall be upon the said land at the time of my death and all of my medicine, books of physie, and anatomy, and instruments of surgery also all my plate and household furniture except one feather bed and furniture to be delivered to each of daughters, Eleanor and Beatrix at the time of their respective marriage or obtaining the age of twenty one, and two feather beds to be delivered to my son Mungo Roy when my executors shall think proper.
Item, I give to my son Mungo Roy all my lands in the County of Orange also fourteen slaves named Rodger, Harry, Dick, Pompey, Dianah, Tost, Frederick, Winney, Moor, Kate, and others. To the said Mungo Roy and the heirs of his body lawfully begotten and for want of such heirs to my son James Roy and the heirs of his body lawfully begotten forever. Then I give to my son Mungo Roy all of my stock of cattle, horses and hogs, with all of the tools and utensils of husbandry that shall be on the said lands at the time of my death, and a bed and furniture with my other household furniture that is there with the horse Jackey and my will and [unintelligible]ing is that out of any said stock on any Orange plantation, my son James may be yearly supplied with a fat beef and a fatened [sic] hogs towards maintenance of my son Mungo and daughters Eleanor and Beatrix untill [sic] they shall respectively arrive at the age of twenty one or marriage without being charged anything for their board. In case both of my sons happen to die without issue of their bodies lawfully begotten I will that all my lands and personal estate be sold for the best price that can be gotten for same and the product then to be divided between my grandchildren by my daughter Mary Dick, my grandchildren by my daughter Ann Mercer, and my daughter Jane Micou. Eleanor and Beatrix Roy and in case any of my daughters die before any sons James and Mungo Roy then my will is that her part be equally divided among the surviving sisters in case there be no children alive of the deceased daughter. But if any my will is that the Mother's part be equally divided among such children. In case my son James Roy shall refuse to come and live upon my plantation and there maintain and take care of his brothers and sisters untill [sic] they are twenty one years of age or marry according to this my will, I give all the lands and slaves heretofore mentioned to be given to my son James Roy unto my son Mungo Roy and the heirs of his body lawfully begotten forever.
Item. I leave to my friend Anderson for the use of my daughter Ann Mercer seven slaves named James, Bon, Leak, Rachel, Phyllis, Dianah's daughter Sarah, Leak's son Sa[mm?]ey and if my daughter survive [sic] her husband my will is that she have the absolute property in the said seven slaves and their increase. But if my said daughter dies before her said husband than my will is that the seven slaves with their increase be equally divided according to their value between my grandchildren Horace Fenton Mercer, Mungo Roy Mercer and Eleanor Mercer. Then I give and bequeath to my granddaughter Mary Dick if she attains the age of 21 years or marries, Silva's daughter Esther and her increase. But if she dies before this time of marries I give the same to my granddaughter Eleanor Dick. Then I give to my daughter Jane Micou ten pounds to be paid to her by executors as soon as they can. Then I leave to my daughter Eleanor Roy the sum of two hundred and twenty pounds to be paid to her by my executors as soon as she arrives at the age of twenty one years. In case she shall marry before she attains this age the said sum to be paid as soon as my executors can conveniently raise the same by the sale of slaves or by the crops that shall be on hand at the time at my death. But in case my said daughter daughter Eleanor shall die before she attains the age of twenty one years or marry that I will the said two hundred and twenty to my daughter Beatrix Roy. Then my will is that all the rest of my slaves not disposed of here or that I may die possessed of and the crop of tobacco that shall be on my place at the time of my death shall after paying my first and lawful debts shall be placed out at interest which interest shall be applied to the clothing of my daughters Eleanor and Beatrix untill [sic] they respectfully [sic] attain the age of twenty one years at which time my executors shall first pay to my daughters Eleanor the above two hundred and twenty pounds and all the remainder I leave to my daughter Beatrix to be paid to her as soon as she shall attain the age of twenty one or marry and in case she die [sic] before she attains the age of twenty one or marry then I leave the sum to my daughter Eleanor if she be unmarried at the time of her sister Beatrix['s] death. But if she be married at the time then my will is that all I have hereby left to my daughter Beatrix be equally divided between my two sons James and Mungo as I have sent to England for some goods for my family use part of which I expect this year and the other part the next year my will is that such of things as are for the clothing of my slaves be applied to that use and those for the use of my sons and daughters Eleanor and Beatrix may be divided and delivered then and the remainder to be equally between my sons and daughters Eleanor and Beatrix.
Lastly, I appoint Andrews Anderson unto whose case as a guardian for my grandchildren Rose Paul Micou and executor of this my last will and testament hereby revoking all other wills by me heretofore made and what money I have in the house and what may be due to me in Great Britain may be applied to pay Mr. Paul Micou as far as I am indebted to him and the surplus (if any) together with what debts are due to use of my estate as not herein before mentioned I give to be equally divided between my two sons all my debts being first paid out of this sum.
