In 1854, the estate (of Thomas J Brasher) devised to Mitchell from the rest of the heirs.

This indenture made and entered into this 31st day of March 1854 between John Brasher and Betsy his wife, James Brasher, H B Brasher and Nancy his wife, Jesse Hamby and Peggy Hamby his wife late Peggy Brasher, and Jeremiah Hamby and Sally Hamby late Sally Brasher his wife, William Brasher, John Brasher, and James * Brasher , heirs at law of William Brasher, deceased, Benjamin Gains and Narcissa his wife late Narcissa Brasher, William Gaines and martha Gaines late Martha Brasher and Marinda ** Brasher, heirs at lawa of Alexander Brasher deceased, all of the County of Crittenden and State of Kentucky of the one part, and Mitchel Brasher of the county and state aforesaid of the other part.

Witnesseth that for and in consideration of the fact that in the lifetime of our father Thomas Brasher deceased it was his intention to convey a certain tract of land (herinafter described) to Mitchell Brasher and for the further consideration of one dollar to us in hand paid by the said Mitchell . . . a certain tract . . . lying partly in Caldwell and partly in Crittenden County of the State of Kentucky, and bounded as follows, to wit . . .

To have and to hold . . . In testimony whereof we the said parties of the first part have hereunto set our hands and seals day and date aforesaid.

  • James is apparently a misreading for Thomas; all the other documents give Thomas M Brasher as William's other son.
    • Note that among those of the "first part" is Marinda Brasher; but those sigining included S C Chadwick (supposed to be Silas F) and M A (Marinda A) Chadwick. Silas Chadwick married Marinda Brasher, 5 March 1855, at home of R G Stewart (her guardian), Crittenden County, Kentucky.


Mitchell moved to Missouri and lived there 1858-1865. After the Civil War, he lost his land to taxes and other troubles and moved back to Kentucky.
