Will of Mathew Avery

Will of Mathew Avery, written 22 April 1642, proven 13 April 1643, London.
In the name of God amen, the two and twentyeth day of the month of April Anno Domini one thousand six hundred forty & two and in the year of the Reigne of our Sovereign Lord Charles, King and defender of the fayth by the grace of God of England, Scotland, France & Ireland. I Mathew Avery of Wapping in the parish of St. Mary Matfelon, called Whitechapel, in the county of Middlesex, mariner, being sick of body, but perfect of mind and memory, thanks to almighty God for the same, do hereby make this my last will and testament in manner & form following:
I give & bequeath my Soule unto almighty God. Item: My body I commit to the earth to be decently buried in the Chappell of Wapping aforesaid at the will and disposing of my executrix herein named. Item: I give and bequeath my goods and estate in manner and form following: I give and bequeath to my loving wife Anna Avery as well all and singular those two messuages or tenements and four hundred acres of land, be it more or less, thereunto belonging, which I purchased & bought and built situated and being in Charlestown in New England in the parts beyond the seas, and all and singular the appurtenances thereunto belonging or any wise appteyning. And also all and singular my goods, money, plate, moveable and immoveable, and other mine estate whatsoever, which now I have or any manner of ways properly by right appteyneth unto me as well within the realm of England, or else for and to her own beheasse, to be disposed according as to her discretion shall seem to warrant.
And my wll & meaning is that all such remainder of my total estate to her bequeathed as at the decease of the said Anna my wife shall be found remaining and unspent, shall come unto my natural sonne John Avery & to his heirs of his body lawfully begotten forever, for him or them to be possessed thereof at the will and appoyntment & discretion of Anna my wife. And if it shall so happen that the said John Avery shall decease this present life without heirs of his body lawfully begotten, then my will & meaning is that all such remainder of my estate as shall come unto him, and at his decease shall be found to remaine unexpended shall remaine & come & be disposed in manner & form following: two third parts thereof unto my loving kinsman William Bundocke the younger, and one third part thereof unto my other loving kinsman William Humphrey the younger, their & any of their heirs of their bodies lawfully begotten, forever. And I the said Mathew Avery do hereby make, ordaine, nominate & appoint the said Anna my wife my full & sole executrix of this my present last will and testament. In witness whereof I the said Mathew Avery have here unto sett my hand & seale dated on the day & year first above written.
