Will Transcript

In the name of God, amen. I Mary Truman Fendall, being os sound mind and memory, do make and constitute this my last will and testament in manner and form following: I give and bequeath to my daughter Sabina Truman Fendall Ford for and during her natural life the use of 100 acres of land, the old cleared land upon which Josias B. Ford now resides, including the improvements or so much thereof as will amount to 70 acres and 30 acres of woodland, that is as much as will make 30 acres including the ground that Josias B. Ford has cleared since he has occupied the place, which woodland to be laid off adjoining the above mentioned newly cleared land, and in case my daughter Sabina T. Ford shall die before her husband Josias B. Ford has had the use of the land he now lives on long enough to repay himself for the expenses of the buildings and improvements, which he has put on the same, then my will and desire is that the said Josias B. Ford shall retain the use of the said land long enough thereafter to satisfy himself for what may be then due to him for said buildings and improvements, and after Josias B. Ford shall have been satisfied as above, and after the death of my daughter Sabina T. Ford, then I give and bequeath to my son Benjamin T. Fendall and his heirs forever the above mentioned 100 acres of land.
Item: I give and bequeath to my daughter Sabina T. Ford and her heirs, one heifer, 6 china cups and saucers, the half of my wearing apparel, one pair of cotton sheets and pillow cases, and a suit of mourning.
Item: I give and bequeath to my daughter Mary Truman Fendall and her heirs forever, 100 acres of land to be laid off in a convenient form so as to include the storehouse and to include at least 30 acres of woodland.
Item: I give and bequeath to my daughter Mary Truman Fendall for and during her natural life the use of my present dwelling house together with the garden and yard adjoining and all the houses including in the same. Also, the land included in the lane as it now stands and divided which leads from the yard to the main road, also a tobacco level line at the back of the garden and kitchen and the tobacco houses standing on it, also a small tobacco level which lies facing the hall door.
Item: After the death of my daughter Mary T. Fendall, I give and bequeath to my son Benjamin T. Fendall and his heirs forever all the houses grounds and lands so intended in the preceding clause of this my last will.
Item: I give and bequeath to my son Benjamin T. Fendall and his heirs forever all the remaining part of my lands, tenements, houses and improvements (except as above disposed otherwise) but under condition that upon my death he is to furnish my daughter Mary T. Fendall with a reasonable share of provisions to serve her and her family and stock for the remainder of that year in which my death may happen and also upon the further consideration that he allows her the privilege of having apples out of his orchard and of pasturage for her stock, such as his own, so long as she continues unmarried. But in the event of her marriage then the two last mentioned privileges to cease.
Item: I give and bequeath to my son Benjamin T. Fendall and his heirs three draught horses called Vulcan, Lock, and Regulus. Also my cart and oxen, one cow and calf, a bedstead standing in the shed room, one white cotton bed bolster, two pillows, one pair of sheets of white Holland, one quilt, one large green and white china bowl, and my picture.
Item: After my just debts are paid I give and bequeath to my daughter Mary Truman Fendall and her heirs forever, all the remainder and residue of my personal estate, goods and chattels of whatever it may consist.
Lastly, I do hereby appoint and constitute my daughter, Mary Truman Fendall, whole and sole executrix of this my last will and testament in testimony whereof I have here and tofore set my hand and seal this 28th day of September anno domini 1805 signed and sealed and acknowledged before us who in the presence of each other and in the presence and at the request of the testatrix have subscribed our names as witnesses thereto.

Charles County. June 15th 1807. Then came James Fenwick, one of the subscribing witnesses to the within last will and testament of Mary Truman Fendall, late of Charles County, deceased, and made oath on the Holy Evanglis of Almighty God that they did see the testrix therein named sign and seal this will and that he heard her publically pronounce and declare the same to be her last will and testament that at the time of her so doing she was to the best of his apprehension of sound and disposing mind, memory and other understanding and that he together with Samuel MacPherson and Walter W. MacPherson, the other subscribing witness, respectively subscribed their names as witnesses to this will and in the presence and at the request of the testrix and in the presence of each other.

    Mary married Benjamin Fendall II (1739-1786) on March 31, 1765 in Charles Co., MD.

    Benjamin and Mary had the following children:

    1) Sabina Trueman Fendall b. 7-23-1766 Charles Co., MD. d. 12-22-1821 Charles Co., MD.
    m.1) Allen Tuedman;
    m.2) Josias Beall Ford, Esq. (1768-1824).

    2) Mariamne Eleanor Fendall b. 1-26-1775 Charles Co., MD. (died 3-2-1775 MD.).

    3) Mary Trueman Fendall b. 9-28-1777 Charles Co., MD. d. ca. 1855. (never married)

    4) Capt. Benjamin Trueman Fendall III b. 11-10-1780 Charles Co., MD. d. 9-25-1849 "Wyoming", Piscataway District, Prince George's Co., MD.
    m. Elizabeth Alexander "Eliza" Dade (1781-1848).

    Mary received from her older brother, Richard Truman Stoddert (1741-1769) a tract of 500 acres known as “ Southampton Enlarged”. This property was located on the Potomac River in the Pomonkey Creek in Charles Co., Maryland (originally Prince George’s County). Richard had obtained the property from his older brother, John Truman Stoddert, Gent. (1732-1765), who had inherited the tract from his father Capt. John Stoddert (ca. 1710-1767).
