    I Mary Silver of Frederick County and State of Virginia of sound Mind But calling to mind the uncertainty of time do make and declare this instrument of Writing to be my last Will & Testament as followeth to Wit
    1st I Will and desire that as soon as practicable after my Desease all my Just debts and funeral Expences be faithfully and punctually paid By my Executros hereinafter named and appointed from the money arrising from the sale of So much property as will Discharge the same or Out of my Standing Debts if there may appear to be a Sufficiency to discharge the Same.
    2d I Will and Bequeath unto my Daughter Nancy one Bed Bed Stead and Bedding as good as any in my House also one white Counterpin one large Arm Chair one good Cow and ten Dollars in Cash.
    3d I Will and Bequeath unto my Son Samuel one Horse the Second Choice among my Horses and twenty Dollars in Cash to be paid by my Executors.
    4th having Giving to my son William Silver my Daughter Bershaba Mendenhall, Hetty Ford and my son Edward Silver & my son George Silver and Joseph Silver all I intend giving them But I will one dollar to Each of them and no more.
    5th I will unto my son Thomas Silver two Horses creatures Namely peg & Gin one Bed and Bedding
    6th I Will and Bequeath unto my Daughter Lucretta Her Bed Bed stead & Bedding one Cow of her own choice one set of New Windsor Chairs one spining wheel and all things that is in the House that she Calls her own and claims them as Such at the time of my decease teh Ballance of all my property I Wish Sold and after Discharging all Just debts and Legesies above mentioned together with my out Standing Debts to be Equally Divided Between my son Thomas Silver & my Daughter Lucretta Silver and to now one else.
    And lastly, I dop hereby constitute and appoint my trusty friend Francis Silver & my son Thomas Silver as my Executors to Execute this my last Will and testament Hereby annulling all wills heretofore by me maid in Witness I have hereunto set my hand & affixed my seal this first day of March one thousand Eight Hundred and Twenty five interlined before Signed

    At a Court held for Berkeley County the 9th day of May 1825
    This Last Will and Testament of Mary Silver deceased was produced in Court and Francis Silver one of the Executors therein named appeared and in open Court refused taking upon himself the burthen of the Execution thereof, which is Ordered to be Certified, and Said Will proven by the Oath of said Francis Silver one of the Withnesses thereto, and Ordered to be recorded. And on the motion of Thomas Silver the other Executor therein named who made Oath thereto according to Law, Certificate is granted him for obtaining a probat thereof in due form giving Security; whereupon he together with Security entered into and acknownledged bond Conditioned as the law directs.

    Mary was the daughter of George Hackett (died 1800), a Revolutionary War soldier, and Elizabeth (?) Hackett.
    Mary married Francis Silver, Sr., (1740-1815) in 1778 as his second wife.
    In 1778 the Silvers and the Hacketts were near neighbors in East Pennsboro(ugh), Pennsylvania. Later the Hackett family lived in Tyrone Township, Perry County, Pennsylvania, and Mary is mentioned in her father's will.
    Francis and Mary had 10 children, all of whom are mentioned in their mother's will which was probated in Berkeley County, (now West) Virginia in 1825.

    The other children of Francis and Mary were:

    1) Dr. William Mark Silvers (1774/80 - 1866) was born in Cumberland County, PA. He married Mary (Myers) Silvers (born c.1783) on 23 Mar 1805 in Berkeley County, (now) West Virginia. Mary was the daughter of Teter Myers, Sr. (16 Mar 1751 - 5 Apr 1838) and Margaret (Behr/Beare) Myers (10 June 1756 - 10 Oct 1818).

    2) Joseph Silver married Sarah (Miller) Silver on 20 Apr 1813.

    3) Bathsheba (Silver) Mendenhall (died 27 Dec 1836) married Jacob Mendenhall on 3 Oct 1803 in Washington County, Maryland.

    4) Harriet (Silver) Ford ["Hetty"] married Joseph Ford in 1803.

    5) George Silver

    6) Edward Silver (18 Apr 1796 - 8 Oct 1837) married Mary (Locker) Silver in 1818.

    7) Samuel Silver (27 May 1797 - 27 Nov 1847). He [1st] married Nancy (Blackman) Silver or Mary Locher (Blackburn) Silver in 1822. Samuel [2nd] married Anne (Otto) Silver on 23 May 1825.
