Dugger) LAST WILL AND TESTAMENT OF MARMADUKE CHEATHAM April 30,1762 In the Name of God Amen the thirthieth Day of April one Thousand seven Hundred and sixty two I Marmaduke Cheatham being Sick and weak in body but of sound and perfect memory thanks be Given to God for the same and knowing the uncertainly of the life on Earth and being anxious to Settle things in order do make this my last Will and Testament in manner and form following That ----Say first and principally I recommending my soul to almighty God my Creator assuredly believing that I shall receive full pardon and full remission of all my Sins and be Saved by the precious death and merits of my Beloved Saviour and redeemer Christ Jesus and by body to the earth from whence it was Taken and to be buried in such decent and Christian manner as to my Exetors[sic] hereafter named as shall be thought meet and Convenient and as Touching Such Worldly Estate as the Lord in mercy hath Sent me my Will and meaning is the same. Shall be employed and bestowed as hereafter by this my Will Enforced and first I do revoke and renounce frustrate and make Void all Wills by me formerly made and declare and appoint This my last will and Testament. I give unto my wife Susanna her Maintenance if she will come and live at home I give and bequeath unto my Son John the Land and plantation whereon he now lives by Estimation one hundred and Eighty acres to him and the Lawful heirs of his body. I give and bequeath unto my son James one hundred and fifty acres I purchased of John Person[?] which being part of Three ----------------of --------[James?} D---d beginning at a bridge on----- Branch Catted Toms so running a strait Line to the Head Line the Last of the said Land to him and the Lawful heirs of his Body also I give my son James a Negroe Girl Named Janey also one feather bed and furniture of five pounds price also two Cows and Calves and one young beast of two years old. I give and bequeath unto my son Benjamin One Hundred and fifty acres of Land which being the remainder part of the land which I purchased of Persons and is bounded on the upper side of my Son James land and as is mentioned in the Deed to him and the Lawful heirs of his Body also a negroe Girl named anaea which is now living with him also one Gun I give my Son Benjamin which he now has in possession. I give and bequeath unto my son Joseph the Land and Plantation whereon I now live to him and the Lawful heirs of his Body also I give my Son Joseph one negroe woman named Cate one negroe woman named Pat one Negroe Boy named [Szer??] provided if Cate Should have another Child That at the age of two or three years old he shall Give it my GrandSon James Cheatham son of John Cheatham one feather bed and furniture five pounds price two Cows and Calves one young beast of two or three years old one Chest of Draws and Largest Looking Glass one [Currcing] knife I give and bequeath unto my Daughter Sarah one Negroe Girl named nel I Lend unto my Daughter ann The use of a negroe Girl named Lucy and after That to her son Joseph Simmons I give unto m y Daughter Elizabeth one negroe Girl named Juner also one feather bed and furniture five pounds price also two Cows and Calves' I give John Dugger Son of Lydia Dugger Decd. One Cow and Calf I have one negroe Girl named mol to be sold and to pay of my Just debts. My will and meaning is that after the Legacies any my Just debts paid that the remainder part of my Estate to be equally divided between my four Sons my desire is that my Estate may not be appraised nor Sold and that my four Sons may agree and see this my will performed. My desire is that my beloved son John and Joseph to be my [hole and Sole as] to see this my will performed.
