2 bank robbers seek reduced sentences

Two brothers serving prison terms of 14 1/2 to 15 years for a series of bank robberies in 1983 petitioned yesterday for reductions in their sentences contending that they are due consideration for providing help to organized crime investigations.
Louis Swenor, 55, and Harold Swenor, 52, both of Springfield, petitioned Judge John F. Moriarty in Hampden County Superior Court to have their sentences reduced to six to nine years, which they contend was part of an agreement with former District Attorney Matthew J. Ryan Jr.

According to nearly identical affidavits filed by the Swenors, they believed that at the time of sentencing they were promised the reduction if they gave the assistance. Assistant District Attorney Judy G. Zeprun said she is trying to locate a transcript of a conversation during a hearing in June 1986 at which the details of the plea agreement were spelled out to Judge Elizabeth Porada.

Both men wrote in their affidavits, "I upheld my end of the bargain and provided information to the district attorney's office, yet they failed to uphold their end to assist me in a reduction of sentence."

Former Assistant District Attorney Francis W. Bloom, who prosecuted them, also filed an affidavit in which no mention is made of a reduced sentence.

"During the course of an ongoing investigation into organized crime . . . these defendants provided continuous information to myself and others assigned" to the investigation, Bloom wrote.

Probation Officer William M. Sullivan said he recalls a conversation that "if the information proved fruitful," the prosecution would consider a reduced sentence. He and State Police Sgt. Michael Fitzgerald said that the information provided led to successful prosecutions.

The Swenors admitted robbing a Western Massachusetts Electric Co. office,a branch of Ludlow Savings Bank, a branch of Union Federal Savings Bank and the East Longmeadow branch of Bank of Boston in 1982 and 1983.
