This is the Last Will & Testament of Lewis Flint made on the 19th of September 1818 in Shillington, Bedfordshire. This is the last will and Testament of me Lewis Flint of Shillington in the County of Bedfords, Taylor (tailor) first I order and direct all my, just Debts funeral and Testamentary expenses to be paid and discharged by my Executors hereinafter named. Also I give and bequeath unto my Two Daughters Elizabeth and Mary Flint such and so many of my Household Goods and Furniture as they shall make choice of to the value of Twelve Pounds each if they shall at my decease be Single and unmarried but not otherwise and which I direct to be delivered unto them as soon as they ask for the same after my Internment Also I give and bequeath unto Mary my Wife All and every the rest and residue of my said Household Goods and Furniture Linen And Plate and which at my decease shall be in and about my Dwelling House for her sole use and benefit Also I give Will and devise unto my said Wife All that my freehold Messuage Cottage or Tenement situate at Shillington afore said with the Bakehouse Yards Gardens Buildings and Close or piece of arable (land suitable for crop production) land and all and singular other the Hereditaments Rights Members and appurtenances (belongings) to the same belonging and appertaining To hold the same unto any said Wife and her assigns for and during the --- Term of her natural life she keeping the same in good repair And from and after my said wife's decease I give Will and devise all and every the said premises with the Rights member and appertenances thereunto belonging unto my Son John Flint and my Friend & son in Law David Simkins of Shillington ------- To hold the same unto and to the use of them and the Survivor of them and the heirs and Assigns of such Survivor for ever But subject to the several uses Trusts intents and purposes hereinafter mentioned and declared of and 30 concerning the same that is to say UponTrust that the said John Flint and David Simkins ---- or the Survivor of them or the Heirs and assigns of such survivor Do and shall in the life time of my said Wife (if she shall need and absolutely require the same) raise by Mortgage of the whole or any part of my said Freehold Hereditaments and premises so devised to them as aforesaid any sum or sums of Money she shall require or make an Absolute Sale there of in order for the better support and maintenance of my said Wife But Subject to this Condition and my desire is that my said Trustees do and shall offer the sale and purchase of my said Estate and premises to my Son William Flint to be taken by him at a fair Valuation and appraisement to be made by Two or three indifferent persons to be appointed as is customary on such like occasions and which is to be paid for at such time or times as shall be agreed to and appointed by the said persons who shall make the said valuation and appraisement. But in case my said Trustee shall not with the privity or by the desire of my said Wife / Sell or dispose of my said Hereditaments and premises in her life time I then order and direct that my said Trustees or the Survivor of them or the Heirs of such Survivor do and shall immediately after my said Wife decease offer the sale and purchase thereof to my said Son William Flint on the terms and in manner afore said or on his refusing to purchase the same To sell and dispose of my said Message Cottage or Tenement Bakehouse Close and premises so devised to them as aforesaid either by private Sale or Public Auction which shall be thought most desirable and out of the Money to arise thereof In the first place to pay off and discharge any Mortgage or Mortgages that my then affect the same or any part thereof Then upon trust that the said Trustees or the Survivor of them or the Heirs of such Survivor do and shall pay and divide the residue and surplus of the said purchase Money unto and among all my Sons and Daughters the living equally share and share alike. But my Mind and Will is that in Case of the decease of any or either of my said Sons or Daughters in the life time of my said Wife without leaving lawful issue I then give and bequeath his her or their shares unto my Surviving Sons and Daughters and their respective Children they taking their own Parents Interest equally share and share alike But in Case he she or they so dying shall leave lawful issue I then give and bequeath the share or shares of him or her or them so dying in the life time of my said Wife unto his her and their respective Child or Children share and share alike if more than one then to such only Child And I do hereby declare and my mind and will is that the purchaser or purchasers of my said Message Land and premises or of any part there of need not attend to or inquire as to the application of the Purchase Money for which they be sold Or shall the Purchaser or Purchasers thereof be in any wise answerable for the proper and faithful application thereof but the receipt and discharge of my said Trustees or the Survivor of them or the Heir of such Survivor for the said Purchase Money shall be good and valid receipts and discharged for the same allowed as such in any Court of Law or Equity And my Mind and Will also that it shall and may be lawful to and for my said Trustees or the Survivor of them or the Heirs of such Survivor to reimburse himself and themselves out of the Trust Monies which shall come to their Hands All such Costs Charges and expenses he or they shall or may be put unto in performing and carrying unto effect the trust hereby by me reposed in them And that the said Trustees or the Survivor of them or the Heirs of such Survivor shall not be answerable or in any wise charged or liable for any more Monies than shall come to their hands respectively nor for the Acts Deeds Defaults receipts or payments of the other of them but each for his own acts deeds and transactions only or shall he or they be answerable for any loss which may happen by placing the said Money or any part thereof in any Country Bank Nor for any loss which may happen without loss or their willful neglect or default And as to all the rest residue and remainder of my Monies Stock personal Estate and Effects whatsoever and wheresoever the same my be and consist of I give and bequeath unto my said Wife and my said Trustees Upon the Trust before and hereinafter mentioned that is to say First I order and direct all my Just Debts funeral and Testamentary expenses be paid and discharged Then upon Trust that the residue and remainder thereof be 31 paid and applied for the support and maintenance of my said Wife foreand during the term of her natural life and in such facts shares and proportions as my said Wife shall require for her own support and maintenance and as shall be deemed necessary and needful Thereto by my said Trustees and what shall remain unapplied at the time of my said Wife decease I give and bequeath unto my said Trustees Subject to the same uses trust Events intents and purposes as are hereinbefore mentioned and set for the touching and concerning the application and distribution of the Money to arise by the sale of my said Real Estate as afore said unto and among my said Sons and Daughters with the benefit of Survivorship as aforesaid in Case of any or either of their Deceases as aforesaid without I issue And I do hereby nominate constitute and appoint my said Wife and my said Son John Flint and the said David Simkins Joint Executria and Exectors of this my last will and Testament and do hereby revoke all former Wills by me at time heretofore made and declare this to be my last Will and Testament In witness to this my last will and Testament contained on three sheets of paper to the two first thereof set my hand only whereof I the said Lewis Flint have my hand and seal this nineteenth day of September in the year of our Lord Christ One thousand eight hundred and eighteen Signed sealed published and declared by the above named Lewis Flint the Testator as and for his last will and testament in the presence of us who in his presence at his request and in the presence of each other have herein to Subscribed or Names as Witness thereof John Flint John Wellingham The Mark X of John Rust |
