[A long and contentious probate, much of it skipped, appearing to add no genealogical information. Note that according to the Fairbanks Genealogy, William Brooks is the only son of William Brooks and Jonathan's daughter Thankful. On 18 Sep 1799, William Fairbank administrator complained to judge that he suspected Sam'l Whitcomb and Thankful Whitcomb his wife had taken some assets of the estate (there is a marriage in 1794 between Samuel Whitcomb and Thankful Fairbanks of Sterling [her relationship to this family is not given in the Fairbanks Genealogy, but Samuel is probably the son of Jonathan's second wife by her first husband]).]
Will of "Jonathan Fairbanks of Sterling" dated 31 Jul 1798, filed 20 Aug 1798, disallowed, names wife Submit, eldest son Jabez Fairbanks, second son Lemuel Fairbanks, third son Seth Fairbanks, William Brooks, daughter Rebeccah Moor, William Fairbanks. William Fairbanks to be executor.
2 May 1799: Dower set off to Submit Fairbank the widdow of the said deceased.
16 Oct 1800: Division of real estate of Jonathan Fairbanks late of said Sterling deceased: to Jabez Fairbank he paying William Brooks, to Lemuel Fairbank, he paying Oliver Moore and his wife Rebeccah, to Seth Fairbank he paying William Brooks, to William Fairbank he paying Oliver Moore and Rebeccah his wife, to Oliver Moore and Rebecka his wife.
