We the lawful heirs of John Zachry late of the county declared, do severally and jointly agree to divide the property of said deceased among the lawful heirs in the following manner to wit:
First - to have the property appraised and let our mother, Sarah, choose her third. Second - to give to John S. Zachry on half of the lot of land whereas he did live, the half adjoining William Brown, Senior land.
Third - to give one Negro girl named Mariah to Sally S. Zachry granddaughter of said deceased.
Fourth - to give to Julia Dismukes and Celia Lochlin one feather bed and furniture each
The rest of the property to be equally divided among the heirs of said deceased in the following manner. The Negroes to be appraised, and put in seven lots, and the heirs to draw for choice and any getting smaller lots shall be made equal out of the rest of the property by taking notes to bear interest from the date of the division, and the property consisting of horses, cows, sheep, goats, hogs, household and kitchen furniture, with all the appurtenances belonging to the plantation, to be sold as a credit and we the heirs do hereby appoint Daniel H. Zachry and Abner Zachry as our agents to act for us in all the affairs relative to said estate. our Mother, Sarah Zachry giving bond and security for the safe keeping of the property left in her possession, and at her death to be equally divided among the lawful heirs as before mentioned.
Given under our hands and seals this first day of March one thousand eight hundred and thirteen.
