Will of John Yager

Will of John Yeager, Sr. Madison Co., VA February 1823

In the name of God Amen. I John Yeager of the County of Madison and Commonwealth of Virginia being weak in body but of sound mind and memory, and knowing its appointed for all men once to die, do make and ordain this my last Will and Testment, revoking and disannulling all other Wills therefore made by me. As touching the worldly property wherewith it hath pleased the Almighty God to help me, I give and dispose of in manner and form following, Viz.
I Will that my tract of land whereon I now live shall be sold on a credit of one, two, or three annual payments as my executors think proper, my slaves shall be sold to the highest bidder on a credit of twelve months for all sums exceeding five dollars the pruchasers giving bond with approved security; my house wench Sarah shall have her freedom and twenty dollars out of my estate at my decease.
I Will if any of my children are deceased who have children also deceased, and have left bodily heirs behind, these heirs shall have full title to their Father's of Mother's part coming to them from my estate: but should the last mentioned have no bodily heirs, their part shall be equally divided among their brothers and sisters.
I Will that my excutors shall have full power to make a legal right to the purchasers fo my land, and other property (if required) Futhermore I ordain that my excutors shall settle and divide my estate among the legatees by and according to the book of accounts of property and money formerly divided among them.
I do hereby appoint Benjamin Gaar and Joel Utz Excutors of this my last Will and testment and sincerely hope that my estate may be settled without altercation or litegation. O may the peace of God which passeth all understanding keep your hearts and minds in the knowledge and love of God, and preserve your bodies and Souls unto eternal life, Amen, Amen, In conformation of these presents I hereunto set my hand and affix my seal this the twentieth day of February in the year of our Lord one thousand eight hundred and twenty three

At a Court held for Madison County the 24th day of August 1826.
This Last Will and testment of John Yeager deceased was produced into Court and proved by the oaths of Bartlett Rosson and Abel Carpenter witnesses thereof and ordered to be recorded. The execors in said Will named refused to take upon themselves the exeon thereof; on the motion of Benjamin Gaar and Joel Utz letters of Administration with the Will ammesced on the estate of said deceased, was granted them in due form, whereupon they qualified and entered bond with security according to law.

Information on John Yager

"Blind John" was born 15 September 1732, died 17 August 1826 -- quite a long life. His wife died in 1800.

Quoting from A. L. Keith, "William & Mary Quarterly," Vol. 26, First Series, p. 192:

"John Yager, son of Adam Yager, was born Sept. 15, 1732. He lived to a great old age, according to one account dying Aug. 17, 1826, . . . He is frequently spoken of as 'blind John Yager.' The writer has seen a letter written by him in 1818 in which he speaks of his blindness."

p. 614:

"His will was probated in Madison Co., Va., Aug. 24, 1826. For some years before his death he was totally blind and is sometimes referred to as 'blind John Yager.' He served as one of the trustees of Hebron Lutheran Church. He married Mary Wilhoit, daughter of John Wilhoit. The writer owns a pair of brass and silver cups, of simple and elegant form, which once belonged to this John Yager. They are engraved with the initials J and M, for John and Mary, and tradition claims that they were made to John Yager's order that they might have them to drink their brandy from. As Mary died before 1800 these cups are now at least 128 years old. John Yager and wife Mary had the following children:
