Edward; no ex; wits: James [JONES], Walter FRANCIS === 1730-1731 Spotsylvania County, Virginia Deed Book B; [Antient Press]; Page 126 This Indenture made the thirteenth day of December Anno Domini one thousand seven hundred and thirty Between JOHN PRICE of the Parish of St. Georges in the County of Spotsylvania Planter of the one part and CHARLES BURGES of the pish of St. Marys White Chappell in the County of Lancaster Merchant of other part. Witnesseth that the said JOHN PRICE for & in consideration of the sum of ten pounds in hand paid the receipt whereof & of every part & parcel thereof he doth hereby acknowledge acquit & discharge the said CHARLES BURGES his heirs Exors. & Admrs. & for divers other good causes and valuable consideration him thereunto moving hath granted released and confirmed and by these presents doth grant release and confirm unto ye said CHARLES BURGES now being in actual possession by force & virtue of a bargain and sale to him thereof made by the said JNO PRICE by Indenture bearing date the twelfth day of this present month of December being from the day next before the date of the said Indenture for one year & by force and virtue of the Statute for Transferring uses into possession and to his heirs and assigns forever all that tract or parcel of land situate lying and being in ye pish of St. Georges in the said County of Spotsylvania bounded as followeth Beginning at a hiccory and two white oakes in EDWARD PRICE's line & runneth thence north seventy degrees west three hundred and eleven pole to a chestnut on the top of a Mountain thence north twenty degrees east five hundred and fifteen pole to a chestnut and two white oakes on the south side of a mountain thence south seventy degrees east three hundred and eleven pole to two red oakes in a poyson field thence to the Beginning place south twenty degrees west to the said EDWARD PRICES corner and from thence the same course along ye sd PRICE's line the Beginning containing one thousand acres by pattent bearing date the eighth day of September Anno Domini one thousand seven hundred and twenty eight & all the Estate right title interest property claime and demand whatsoever of him the said JN PRICE his heirs Exors. Admrs. or assigns of in and to the same promise & every part & parcel thereof with all and singular profits and commoditys thereunto belonging to have and to hold the said land and premises with their and every of their appurtenance without impeachment of any manner of wast unto the said CHARLES BURGES his heirs and assigns forever and to no other use Intent or purpose whatsoever and the said JOHN PRICE for himself his heirs Exors. and Admrs. doth hereby covenant promise and grant to and with the said CHARLES BURGES his heirs and assigns that he the said JN PRICE his heirs Exors. Admrs. the aforesaid land and premises shall forever warrant and defend against all persons whatsoever [the said BURGES rendering the rents and services which is or shall grow due to our Sovereign Lord the King his heirs and Successors] and further the said JOHN PRICE and his heirs from time to time and at all times hereafter during the space of seven years shall and will upon reasonable request and at the cost and charges in law for the said CHARLES BURGES his heirs Exors. Admrs. or assigns do make acknowledge levy execute and suffer all and every such further and other reasonable act and acts conveyance and conveyances and assurances in the law whatsoever for the further and more perfect conveying assuring & sure making the said land and premises with their & every of their appurtenances and every part & parcel thereof unto the said CHARLES BURGES his heirs and assigns by the said CHARLES BURGES his heirs or assigns or his or their Councell Learned in the Law shall be reasonably devised advised or required. In Witness whereof the partys to these presents have hereunto Interchangeably sett their hands & sealsye day & year first above written.
