John Kirk Will
In the name of God, Amen!
I John Kirk, Senr. of the county of Rutherford and the state of Tennessee do make, ordain and declare this to be my last will and testament, revoking all others. What worldly goods God has been pleased to bless me with in this life, I bequeath and leave in the following manner, In the first place it is my will that all my just debts of which there are but few and none of magnitude should be punctually and speedily paid.
First, I will and bequeath to my beloved wife Eleanor Kirk the half of the land I posess, also a negro woman named Dinah and her two children, and all the household furniture and whatever parts of the stock she may see proper to keep.
In the second place I will and bequeath to my beloved daughter Elizabeth the other half of my land, also one negro man named Jack and at her death whatever she may posess after satisfying which ever one she may live with to be equally divided among her brothers and sisters of if dead to their children.
In the third place, it is my will that all the stock after my wife Eleanor chooses her part shall be sold and equally divided amongst all my children, to wit, Jane Bell, and Hugh Kirk, Agness Aberson [??], Martha Montgomery, Eleanor Killough, John Kirk, Jr., also all my farming utensals the above described land left to my wife Eleanor and daughter Elizabeth, it is my will that it should be sold and the money equally divided between them and my daughter Elizabeth's part appropriated to whatever use my executors think most advantageous to her, also her negro man Jack put to whatever use that may be best for her.
I do also constitute and appoint my two sons Hugh & John my Executors and my wife Eleanor Kirk I appoint my executors and do hereunto set my hand and seal this ninth day of October in the year of our Lord eighteen hundred and twenty two.
