WILL OF JOHN KERR, FAUQUIER COUNTY, VA

In the name of God Amen, I John Kerr, Sen. of the County of Fauquier being advanced in years but of sound and perfect memory do constitute and make this my last will and testament in manner and form as following viz, I give and bequeth to my Daughter Margaret Bronaugh five pounds having given her before what I thought I was able to give. Item I give to my Daughter Mary Peters one negro girl by name Charlotte to her and her heirs forever. Item I give to my daughter Betty Kerr one negro woman by name Charity and one negro boy named Nelson to her and her heirs forever also thirty pounds five shillings one saddle and one grey mare colt. Item I give and bequeth to my Daughters Mary Peters, and to Betty Kerr, one negro boy by name Will to them and their heirs forever and it is my desire that if either of my said Daughters Mary Peters or Betty Kerr should die without will that all and every bequeth to them given shall go and belong to the other as I do not wish that the children of the present wife to have any claim to the bequeth given to my first wifes children nor the first wifes children to have any of those of the present wifes. Item I give and bequeth to John Kerr Junr. on negro woman named Rose and her increase and one horse colt to him and his heirs forever. Item I give and Bequeth to my son William Kerr, one Negro Boy named Stephen to him and his heirs forever. Item all the residue of my estate both nal(?) and personaly after my just debts is paid. I leave to the use of Sarah Kerr my wife that is mean(t) to lend the same to her during her life or Widowhood in order that she may be Inabled to raise the young children that I have by her and it is my will that at her Death of marriage, the land whereon I now live fo and belong to my son John Kerr, Junr. to him and his heirs forever by hie mother as it is my will and desire that the children I have had by each wife shall Heir by their mother only this inserted for to prevent disputes between, that is my Intention is for my son William Kerr to Inheirit the land bequethed to my son John Kerr Junr. if he should die before he arrives to the age of twenty one years of age. All the Estate that I have lent to my wife the land excepted with its increase to be equally divided at the death or marriage of wife between my children Sarah Crosby Kerr, William Kerr, Darcus Kerr, Lucy Kerr, Peggy Smith Kerr and Aseneth Kerr to them and their heirs forever. Item it is my will and desire that the marriage of any of my said children if my wife thinks proper she may give them such of the property as convenient which shall bear an equal proportion at the division agreeable to what the value is supposed. Lastly, I appoint my beloved wife Sarah Kerr, John Withers, son of old field and John James my Executors and Executrix of this my Last Will and Testament revokeing all other Wills by me made and requests, In witness whereof I have hereunto set my hand and affixed my seal this eighth day of November 1796.

Dear Sir,

     I believe that John Kerr Married Sarah Smith. Her parents were Henry Smith and Sarah Crosby. Sarah Crosby's parents were Daniel Crosby and Mary Routt.All of Virginia, Stafford County. Sarah was Born I/20/ 1751/52. The child Sarah( Crosby) Kerr and the other child Peggy (Smith) Kerr; indicates the possibility of this Sarah Smith, as being the wife of John Kerr. Any information is greatly appreciated.

Record from Botetourt County, Virginia (may refer to Lucy Kerr, daughter of John Kerr and Sarah:

Name: Annie Ledgerwood Born: 178? Birth Place: Botetourt or Montgomery Co, Va. Spouse: Isaac Epling Yr Married: 1803 Lived In: Virginia Comments: First_Known_Census: 1850

Children: Paul, Henley, Allen, Isaac, Elizabeth, Margaret, Nancy, William, Philip

Died in 1854 so the 1850 was the only one she was named in. Only clue to who her parents might have been was a mention in Botetourt Co., Va. court records, 1784, that said, "John Ledgerwood for keeping Lucy Kerr unlawfully and having a child by her." That's all it said. In 1801 Lucy Kerr became the second wife of Isaac Epling's father in Montgomery Co. and sometime between then and about 1803 Isaac Epling married Annie Ledgerwood. John and Lucy's illegitimate child? No proof has yet been found. Sure need some help.
