State of Virginia County of Madison (SS) On this 23rd day of August 1832 personally appeared in open Court before the Justices of the Court of the County of Madison now sitting a resident of the County & State aforesaid John Jones aged sixty-six years who being first duly sworn according to law doth on his oath make the following declaration in order to obtain the benefit of the act of Congress passed 7 June 1832. That he entered the service of the United States under the following named officers & served as herein stated. Captain Garland Burnley, Lieutenant Thomas Porter, Regiment commanded by Colonel Frank Taylor [Francis Taylor], the Horse commanded by Colonel Bland [Theodorick Bland], he enlisted at Albemarle Barracks in Virginia he went with Burgoyne & his Troops recently captured to Maryland, he was afterwards discharged in Winchester, he has no documentary evidence of his discharge. He herewith forwards the testimony of Thomas Smith who was in service at the same time & whose affidavit is herewith forwarded. He enlisted under said Burnley. He served in the militia at the siege of York under Captain Waugh, he was at the taking of Cornwallis [October 19, 1781] & afterwards discharged near Winchester. He hereby relinquishes every claim whatever for a pension or annuity except the present & declares that his name is not on the pension roll of the agency of any State. Sworn to & subscribed the day & year aforesaid. [Signed] John Jones
State of Virginia County of Madison (SS) On this 28th [?] Day of May 1833 personally appeared in open Court before the Justices of the County Court of Madison now sitting John Jones and made the following additional declaration in order to obtain the benefit of the Act of Congress passed the 7th of June 1832, by way of explanation and stating with greater precision the different grades of service and the length of time he served during the Revolutionary War referring to his declaration made in this Court on the 23rd day of August 1832, and hereto annexed for the names of the officers under whom he served. The said John Jones being duly sworn according to law states that he enlisted when very young he thinks in the year 1778 in the second Virginia State Regiment commanded by Colonel Frank Taylor. The term of his enlistment was two years, he served out the full term of his enlistment, and was then discharged he received a written discharge but has lost or mislaid it. He has the evidence of his of his service in the Affidavit of John Snow who served in the same Regiment with the declarant, whose affidavit is hereunto annexed. In this term of two years service he acted as a private Soldier. Afterwards in the year 1781, the declarant thinks in the month of July, he marched as a substitute for Hoy [?] Taliaferro and served as a private for three months he was at the siege of York and [indecipherable word or words] the Capture of Cornwallis and his Army, he was then sent with the prisoners to the Barracks near Winchester, Frederick County Virginia where he was discharged. He received a written discharge but has lost or mislaid it – he has no documentary evidence upon the subject. The declarant is positive that he served as a private two years as a regular soldier and three months in the Militia for which he claims a pension from the length of time – and his loss of memory he cannot undertake to state the exact dates of his service and the names of all the officers under whom he served or who were present as officers in the different places to which he was marched. [ A. H. Lamon, a clergyman, and Joseph Carpenter gave the standard supporting affidavit.] It is ordered by the court to be certified to the Secretary of War that the following interrogatories were put to the said applicant John Jones and the answers given as set forth to each.
Q. Where and in what year were you born? Answer. In the County of Spotsylvania and raised in the County of Orange Virginia. Q. Have you any record of your age & if so where is it? Answer. I have no record of my age, nor do never had; I may be a few years older than I have stated, I was not sixteen years of age when I enlisted into the service. Q. Where were you living when called into service, where have you lived since the Revolutionary War, and where do you now live Answer. In the County of Orange when called into service. I have lived for the past forty years in the County of Madison. 2. How were you called into service, were you drafted, did you volunteer; or were you a substitute? And if a substitute for whom? Answer. I enlisted in the first Tour for 2 years which I served out and was honorably discharged at the end of the service, afterwards in the year 1781 I went as a substitute for Hay Taliaferro & served 3 months. 2. State the names of some of the regular officers who were with the troops where you served, such Continental and militia Regiments as you can recollect and the General Circumstances of your service. Answer. I knew Major John Roberts of [paper damaged and text written over and rendered illegible]. I saw all Generals Washington, Weedon [George Weedon], Lafayette, Wayne [Anthony Wayne] of the Regulars, James Burton Major & many others not considered material to name. 2. Did you ever receive a discharge from the service, & if so by whom was it given, and what has become of it. Answer. I received a written discharge for the 2 years service, it was given by one Richard Hubb [?]1 I have lost or mislaid it, also the one for the Militia service 2. State the names of persons to whom you are known in your present neighborhood and who can testify as to your character for veracity, and their belief of your services as a Soldier of the Revolution? Answer. I refer for my character for veracity to Major Chapman, Captain Finks, Andrew Finks, William Finks, John Fray and all the rest of my neighbors who will testify to their belief of my services.
Madison County Virginia(SS) This day personally appeared in open Court Thomas Smith and being duly sworn according to law saith that he has long known John Jones a soldier of the Revolution, that the facts as set forth in his declaration made this day before the Court of the County and State aforesaid are substantially true. Sworn to and subscribed this 23rd day of August 1832 S/ Thomas Smith2 State of Virginia Orange County to wit
The affidavit of John Snow aged about seventy-four years and being duly sworn deposeth and saith, that he is acquainted with John Jones of the County of Madison and State aforesaid, that the said John Jones enlisted in the month of March in the year 1778 in the second Virginia State Regiment for two years, which said Regiment was commanded by Colonel Frank Taylor, that the said Jones served out the term of his enlistment as a faithful soldier. This affiant has no knowledge of any other services rendered by said Jones. And further this affiant saith not S/ John Snow3 [Attested April 22nd, 1833 in Orange County Virginia]
[Veteran was pensioned at the rate of $80 per annum commencing March 4th, 1831, for service as a private for 2 years in the Virginia service.]
