His will dated 9 January 1707/08, proved 31 March 1708 (DW 4, Fothergill p. 42). Names sons John and William (land) and wife Sarah executrix.

He was dead before 16 February 1708/09 when Caleb Butler wrote his will naming his sister (sister-in-law) Sarah Elliott, widow. (DW 4:192-194). Butler's will also names Sarah Elliott, daughter of Elizabeth Elliott as part of her legacy from her uncle and godfather John Foxall, the sum £30.

The will of John Foxall written 10 February 1697/98 names Mary Elliott (my mare) and Martha Elliott (my colt). DW 2:135-135a.

The will of Col. Andrew Monroe, gent., dated 30 December 1713, proved 9 June 1714 (DW 5, Fothergill p. 53). Names wife Sarah and daughters-in-law (stepdaughters) Sarah and Elizabeth Elliott.
