- January 10, 1774 (will proven)
- To son Benjamin "Puddington" and Puddington's Harbour", also the dwelling plantation adter the decease of his daughters, Anne Burgess and Susannah Burgess; also negroes.
- To grandson John Burgess, son of the testator's deceased son, William, another portion of "Puddington", but in the event that the said grandson died without issue, then to the testator's grandson, John West Burgess "son of my late son Samuel Burgess.
- To daughters Sarah Disney, Mary Lusbey, Anne Burgess and Susanna Burgess personalty.
- To five sons, John, Joseph, Edward, West and Caleb residue of estate.
- Account settled 4 Feb 1779 by Caleb Burgess and John Burgess with distributions to:
- Jane Burgess, Stephen West, Samuel Burgess and West Burgess.
- Final account made 14 Mar 1780 with distributions to: son Benjamin, Anne Burgess, Susannah Burgis, Sarah Disney, Mary Lusby, Anne Burgess, and sons John Burgess, Joseph Burgess, Edward Burgess, West Burgess and Caleb Burgess.
