Will Transcript

In the name of God amen, I John Booker of the county of Prince Edward to make this my last will and testament, hereby revoking all others heretofore made. In the first place I direct the payment of my just debts and funeral expenses in the most convenient manner out of my estate. ~
Item I give and bequeath unto my son William Booker my negro man little Jim and Maria, and the advancements heretofore made to him. ~
To my daughter Mary Bell I give and bequeath my negroes Ephraim and Nelmw, Fanny and her four children which she has in possession, and the advancements heretofore made her, to her and her heirs forever. ~
To my son Thomas I give negroes Henry and Harriet which he has in possession, to him and his heirs forever. ~
The balance of my personal estate together with the tract of land whereon I now reside, I lend to my beloved wife during her life or widow hood to be kept together for her use and benefits and that of the unmarried part of my children, and when any of them gets married, to have such a portion alloted to them as in the opinion of my executors can be most conveniently spared from the Estate. ~
My Spring Creek plantation I wish to be laid off in two lotts at the discretion of my friends William C. Bell, George M. Bell, Thomas Adams and Richard Booker, one lott of which I give to my son Thomas D. Booker and my daughter Harriet B. Booker, and the other lott I give to my son Edward F. Booker and my daughter Pamelia L. Booker to them and their heirs forever. ~
To my son Samuel and my daughter Elizabeth I give two hundred and sixteen & a half acres of the tract of land whereon I low reside, being the southern part of the tract which will be seen by reference to a survey and platt made by Samuel & Moses in 1822 and marked figure D, to them & their heirs forever. ~
To my son James I give one hundred & sixty five & a half acres of the tract of land on which I reside marked Figure A, on said mentioned platt, by Moses; together with so much of my land as lies on the west side of the road leading from my plantation to Joseph Sharps and also on the north of that line drawn on the said mentioned platt runing South 81 East 245 poles, to him and his heirs forever. ~
I also give to my son James a small tract of land lately purchased by me of Hott?, containing about twenty two & a half acres to him and his heirs forever. ~
The balance of this tract of land on which I reside, I give to my son John Booker and my daughter Martha Jane Booker to them & their heirs forever. ~
It is my will that the balance of my negroes not disposed of on the Spring Creek plantation, should remain there for three years including the present, unless some of my children should get married in that case my executors will exercise their discretion as to removing them. ~
Tis my will & desire that there should be no appraisment of my estate, and that my executors not be held to give security. ~
I appoint my son Thomas D. Booker, my son in law William C. Bell and James D. Wood executors of this my last will and testament.
In witness thereof I have here unto set my hand & affixed my seal this 19th day of January in the year of our Lord, one thousand eight hundred and twenty five.

At a court held for Prince Edward County March the 21st 1825.
This last will and Testament of John Booker dec'd was presented in Court and proved by the oaths of William Scott, Samuel Watson and John P. Mettener? the witnesses thereto ordered that the same be recorded and at the same court continued and held for said county the 22d day of March 1825, James D. Wood one of the executors herein named in open court refuses to take upon himself the burthen of the execution of... this will.. at a court held for Prince Edward County July the 18th 1825. On the motion of Thomas D. Booker and William C. Bell exors. herein named (no security being required by the will) they entered into bond in the penalty of twenty five thousand dollars, conditioned according to law, and took the oath required by law, certificate for obtaining a probat thereof in due form is granted them. ~
