Will Transcript
- July Session 1808, Greene County, Tennessee
- John Bannatt Dec'd, Monday 25th
- The last will and Testament of John Bannat Deceased was produced in Court for probat whereupon came Samuel Wilson and Ephraim Wilson and John Garvin the subscribing Witnesses thereto, and having made oath in due form to the execution thereof.
- It is ordered that the same be recorded, and is as follows:
- In the name of God Amen, I John Bennet of the County of Greene and State of Tennessee being sick and very weak but in perfect mind and sound memory blessed be God, calling to mind the mortality of my body, do make and ordain this my last will and Testament in manner and form as followeth viz.
- First I recommend my soul to god, who gave it, and my body to the earth from whence it came to be decently buried at the discretion of my executors.
- Secondly I gave and bequeath unto my beloved wife Rachel Bennet all the use, interest, profit and emoluments of the plantation on which I now live also of all my personal estate the whole of her natural life, then the land to be sold and equally divided amonst [sic] my sons and daughters and all my personal estate to be wholely and solely at the disposal of my wife at her death.
- Thirdly I allow gave and bequeath unto my son Thomas Bennett fifty dollars out of the price of the land when sold inclusive of his equal share.
- Fourthly and lastly, I appoint my wife Rachel Bennet my whole and sole executor of this my last Will and Testament hereby revoking all other former Wills, legacies, bequeaths, executors by me made heretofore in any way whatever, acknowledging this and no other to be my last will and Testament.
- In witness whereof I have hereunto set my hand and affixt my seal this twenty fifth day of August in the year of our Lord 1807.

- Signed, Sealed and declared by the said John Bennet the Testator as his last Will and Testament in presence of us who were present at Signing and Sealing
- Saml. Wilson, Ephraim Wilson, John Garvin
- Whereupon Rachel Bannat the executrix in the said Will named, and having taken an oath to execute the same as the law directs. It is ordered that letters Testamentary issue to her accoringly.
- Rachal Bannat Executrix of the last will and Testament of John Bannat deceased exhibited in court an inventory of the personal estate of her Testator, which was ordered to be recorded and is as follows "An inventory of the goods and chattels Writes & credits of John Bennet Dec'd."
Records in Tennessee
- Greene Co., TN Land Warrant; 22 Oct. 1783: No. 201, to John Bennett, 300 acres in Green County situate and lying on the Cany branch near the mouth, beginning near the Cedar Spring and running up the branch including his own Improvements where he now lives. Warrant Issued June 7th. 1784.
- Wyatt family records also show that Samuel Wyatt went to Greene Co., Tn. District of N.C. in 1783 where he was listed on the tax list. Prior to that he was proven to have been in the N.C. Continental Line army with his father in law, John Bennett. This John Bennett was proven by military land grant to have been awarded 300 acres in Greene Co., Tn. District of N.C. and is also listed on the 1783 tax list there. A Power of Attorney from Samuel Wyatt, Sr. to his son William in Greeneville, Greene Co., Tn. (formerly Tn. Dist. of N.C.) to recover Samuel's wife Rebecca's interest in her father John Bennett's estate also proves the connection. Tn. didn't become a state until 1796 and John Bennett died in 1808.
