[edit] About Jesse McFarlandJesse McFarland was born abt. 1817 in Virginia [Census Records]. He is likely a sibling to a William McFarland, born abt. 1818, also in Virginia and is buried in the same cemetery as Jesse McFarland's second wife and other family members. [Additional research needed]. Jesse appears to have been in Warren County, Virginia in 1840 with a young wife one son according to the Census, which appears to likely be his son David McFarland, who was born about the same time. By 1850, he had migrated to Muskingum County, Ohio, where he was again listed in the Census there with his wife, Elizabeth [maiden name unknown] and seven children, all born between 1840-1850. The 1860 and 1870 U.S. Census records paint an unfortunate period of Jesse McFarland's life as he was listed as living in the Ohio Penitentiary, located in Columbus, Franklin County, Ohio. According to Court records, Jesse was indicted for "Assault with intent to commit a Rape" against his daughter Huldah McFarland [then about age 12]. Court records allege that on 10 April 1858, Jesse "did make an assault", "unlawfully abuse and ill treat" and "unlawfully, violently, forcibly and against her will to abuse ravish and carnally know, against the form of the statute in such case made and provided and against the peace and dignity of the State of Ohio". He was indicted of this crime during the June 1858 Muskingum County Court in Zanesville, Ohio. He pled not guilty and in November 1858 a Jury Trial ruled him guilty. His attorney motioned the Court for a new trial, but that motion was denied by the Court. Jessee McFarland was convicted by the jury and sentenced to a seven year confinement in the Penitentiary ["imprisoned and kept at hard labor in the Penitentiary of the State of Ohio], which is confirmed in the 1860 and 1870 Census records. In 1870, he was listed as still living in the Ohio Penitentiary, working in a Cooper Shop, making wooden casks, barrels and tubs [1870 Census]. During that time, "prisoners were required to work in one of the prison industries which made everything from harnesses and shoes to barrels and brooms". Source: Ohio Penitentiary in Ohio History Central website It appears that Jesse had paid his debt to society by 1872 when marriage records show that he married Julie Garrett on 10 September 1872 in Muskingum County, Ohio [Ohio Marriages, 1774-1993]. The 1880 U.S. Census shows him still living in Muskingum County with wife Julie and four children born between 1870-1880. His wife Julie died in 1918 and is buried in the Frazeysburg Cemetery in Muskingum County, Ohio.
