Research notes

  • Family tradition states that Jeniah's father died abt 1778 in Monmouth, NJ. His mother remarried a Monroe and was known as "Granny Monroe". Proof needed.

    Last Will and Testament of Jeniah Sutton, Deceased.
    In the name of the Benevolent Father of all,
    I Jeniah Sutton of Kosciusko County and STate of Indiana do make and publish this my last will and testament.

    Item 1st I give to my daughter [in law] Isabel Sutton, one hundred and fifty dollars to be paid out of my Real Estate when cold.

    Item 2nd I give and deliver to my four other children John Sutton, William G. Sutton, Daniel Sutton and Elizabeth Sutton, the balance of all my property, person and Real Estate to be sold and dually divided except one horse and cupboard I have already disposed of.

    I do hereby nominate and appoint James Morris, Executor of this my last will and testament hereby authorizing and empowering him as my executor to settle all my business.

    I do hereby revoke all former wills by me made in testimony hereof I have hereunto set my hand and seal this the 3rd day of April 1867.

    Be it remembered that on the 9th day of December 1870, James Morris, one of the subscribing witnesses to the within and foregoing last will and testament of Jeniah Sutton, late of said County, deceased, personally appeared before Reuben Williams, Clerk of the Court of Common Pleas of Kosciusko County in the State of Indiana and being duly sworn by the Clerk of said Court upon his oath declared and testified as follows that is to say That on the 3d day of April 1867 he saw the said Jeniah Sutton d??? the said instrument in writing to be his last will and Testament and that the said Jeniah Sutton with his consent attested and subscribed by the said James Morris and Vincent D. Campbell, in the presence of said Testater, and in the presence of each other as subscribing witnesses thusto, and that the said Jeniah Sutton was at the time of the signing and subscribing of the said instrument in writing and aforesaid of full age (that is more than twenty one years of age) and of sound and disposing mind and memory and not under any coercion or restraint as the said deponent verily believes: and further deponent says not.
