    "James (Wolcott), b. 1700; d. unmarried on 16 Feb 1747/48 at age 47 according to his gravestone in the Old South Windsor Cemetery (Hale 52). The last of the Wolcott brothers to die, James left an intestate estate. Administration was granted on 8 Mar 1748/9 to his brother-in-law Samuel Treat. An agreement to distribute the estate was reached by Samuel Treat, whose wife Sarah had died prior to this, and by William Stoughton and his wife Martha in right of said Martha. It was recorded on 3 May 1748 (Manwaring 3:690-691)."

    Court Record, Page 61—8 March, 1747-8: This Court grant Adms. on the estate of James Wolcott, late of Windsor decd., to Samuel Treat, late of Wethersfield, who gave bonds with Joseph Newberry of Windsor of £1000.

    Page 185 (Probate Side): An agreement under the hands of William Stoughton: Whereas, there is descended to us, William Stoughton and Martha his wife, in right of sd. Martha, and to Samuel Treat of Wethersfield in his own right, on the death of Mr. James Wolcott of Windsor decd., an estate (real and personal) in such proportion that by the descent aforesd. to them, the sd. William Stoughton and Martha his wife, in right of sd. Martha, belongs one moiety or 1-2 of sd. estate, and to the sd. Samuel Treat another half thereof, they being the only heirs of sd. estate by the descent aforesd.; and whereas, we being minded to divide sd. estate according to our interest and just proportion thereof, viz: We do hereby agree to divide to sd. Samuel Treat, for his half of sd. moveable estate, viz., one negro man named Answer, £240; two horses, £106-00-00; all which amount to £346; together with some of the other articles of sd. moveable estate equally divided to sd. Samuel Treat, amounting to the sum of £380-00-00; and being the sd. Samuel Treat's proportion of sd. moveable estate. 2ndly, we do hereby devise and set out unto the sd. William Stoughton, in right of his wife Martha, for their part of sd. moveable estate, all the cattle and colt, all amounting to £202-00-00, with sundry other articles set out to sd. William Stoughton, in the whole the sum of £380. And we, the sd. William Stoughton and Martha Stoughton of the one part, and Samuel Treat of the other part, do each of us, for ourselves and our heirs, acknowledge we have received our part of sd. moveables.

    At a Court of Probate held at Hartford, 3rd May, A. D. 1748: Then William Stoughton, and Martha Stoughton his wife, and Samuel Treat, signers and sealers of this instrument, acknowledged the same to be their free act and deed, and their hands and seals. Test: Joseph Talcott, Clerk.

    Page 65—3 May, 1748: An agreement for the settlement of the estate of James Wolcott, late of Windsor decd., under the hands of William Stoughton and Martha Stoughton and Samuel Treat, heirs to sd. estate, was now exhibited, which agreement this Court approve, order to be recorded and kept on file."
