Was a sea Captain prior to the Revolution with The East India Co., likely out of Barbadoes. He purchased a lot in Cape Elizabeth, then during the Revolution, moved to Limington Maine.

The entries of James Small in the "wast-book" are many and varied. He evidently was captain of the schooner Nep-tune and of the Hannah and Molly, at different times. There are numerous lists of outfits for various fishing voyages, and distribution of cargoes on his return. On April 12, 1767, it is shown that Henry Dyer owned "1/16 of the Schooner Hanner and Molly," valued at £196: 17: 6, and that Reu-ben Dyer had a like interest. In 1769, Benjamin Fickett (probably Sr.) and James Dyer were paid for repairs on the "scooner Nepten." The names of Smalls that appear most frequently on these accounts are: Elisha, Edward, Israel, Isaac, Ephraim, John, Benjamin, and Mich [Micah]." In June, 1770, Captain James Small "pade Mother Small For Hur Parte off ye House Lefte Hur by my Father Small . . .[£]10: 10: 0." "Mr Joseph Marnor" was interested more or less in Captain Small's fishing ventures, from 1750 to 1769; also his son, "Moses Marner," in 1772 and 1773. John Dyer was mentioned, 1749-1751; Henry Dyer, 1752; "mykel [Micah] Dyer," 1754; "Mr James Dyer," 1760-1769; and Samuel Dyer, 1777. There also was an Israel Dyer, in 1770, whose family connection has not been traced. On Aug. 1, 1774, there was an entry by Captain James Small of a list of stores he had "founde in ye Schoner Molley."

His Revolutionary service consisted of six months and twenty-four days, from Feb. 5, 1776, to Sept. 1, 1776, in Captain Briant Morton's company, stationed on the sea-coast at Cape Elizabeth and Scarborough. He re-enlisted Sept. 1, 1776, and served until Nov. 25, 1776 (service, two months and twenty-five days), in the same company, in Colonel Mitchell's regiment, at Cape Elizabeth and Scar-borough. The name, "James Small, appeared in a list of men who moved from the town of Cape Elizabeth subsequent to 1776, dated Cape Elizabeth, Jan. 17, 1782, accom-panying a petition of the Selectmen stating their inability to supply their quota." In March, 1777, when Peter Woodbury, of Cape Elizabeth, acted as agent to the heirs of Daniel3 Small, of Truro, to prosecute their claims, James Small was firmly established at Ossipee, later Limington. He probably took advantage of a period of good sled-ding, in the winter of 1776-1777, to remove his family. The desire to take them away from the dangers threatening the seacoast towns may have been a factor in his removal just at that time.

That Captain Small had knowledge of the deed dated November 28, 1666, is evident. It purported to convey the "twenty miles square," at Ossipee, from Captain Sandy to Francis2 Small, and was recorded May 24, 1743 (while the original deed was not recorded until Aug. 28, 1773). Entries in his handwriting in the "wast-book" (the first without date) state that Captain James5 Small had been to see "Major Freeman [a lawyer of Falmouth]. . . about the land #04 times . . . for coppeys . . . [£]00. 10. 6;" that he had paid "the Major . . . for the papers . . . £00. 10. 0;" that he had given the Major, "Cash" -on Oct. 2, 1758, .£2: 05: 0, on Nov. 10, 1758, £2: 05: 0, and on April 7, 1759. £2: 05: 0. With the "wast-book" an acknow-ledged but unrecorded deed has been handed down, which is too valuable to omit, since it shows the grounds upon which Captain James6 Small based his claim to land at Limington: -

"Know all Men by these Presents. That I Moses Shattuck of Fal-mouth in the County of Cumberland, and Province of the Massa-chusetts-Bay - Gentlemen am holden and stand firmly bound and obliged unto James Small of Cape Elizabeth in said County - Yeo-man in the full and just Sum of Fifty Pounds lawful money to be paid unto the said James Small his certain Attorney Heirs - Ex-ecutors or Admin'rs to the which payment well and truly to be made I bind myself my Heirs Execu'rs and Administrators firmly by these Presents Sealed with my Seal - Dated at sd Falmouth the twentieth Day of December in the fifteenth Year of His Majestys Reign. Annoque Domini, One Thousand seven hundred and seventy-four.

"The Condition of the above-written Obligation is such, That whereas the said Moses and James have bargained and agreed, that the said James for the consideration hereafter mentioned shou'd give the said Moses a Deed of Sale of one moiety or half part of his the said James Right to a certain Tract of Land lying and bordering upon Piscataqua River, which his Great Grandfather Francis Small purchased of an Indian called Capt. Sandy Nov. 28, 1666. and which he afterwards sold to his Son and my Grandfather Daniel Small late of Truro in the County of Barnstable & Province aforesaid Car-penter deceas'd viz the last Day of October 1712 as by the Deeds recorded in York County Records may appear. And the said Moses on his part having agreed to & with the said James to pay all the Charges that has arisen or may arise in promoting the settle-ment, and recovering and establishing the Title and Claim of said Land, that is to say, the whole Charges which the said James has heretofore been - or may be subject to pay for his whole Right (which is one sixth of two ninths of the whole Tract), until the final recovery and establishment of the Title as aforesaid. And whereas in Consequence & in complience of said Agreement The said James has this Day conveyed one half of his aforesaid Right to the said Moses. Now therefore If the said Moses his Heirs Executors or Administrators shall well and truly pay the whole Charge Tax or Assesment which has been or may be laid on the Said James's Right until the recovery and establishment of the same as aforesaid, and indemnify the said James his Heirs Exec'rs and Administrators from paying any part of such Charge Tax or Assessment, till the recovery and establishment of the Title as aforesaid, then the above written Obligation to be void and of no Effect, else to remain and abide in full force and virtue -

It is apparent from the above document that the record of Isaac4 Small, written on March 7, 1745, of his five chil-dren then living, was made with reference to establishing his claim to the land at Ossipee. The right of "one sixth of two ninths of the whole Tract," owned by his son James, is proof that another child was born after that date. Two ninths represented the interest conveyed to Isaac by his father, Daniel Small, of Truro.

Although Captain James Small appears to have been one of the earliest to take measures to prove his claim at Ossipee, neither he nor his sons became involved in the lawsuits which so disturbed the other settlers. Instead, he - "James Small of Limington. . . mariner " - showed his acquiescence to the decisions of the Courts against other descendants of Daniel Small, and others more or less connected with that family, by purchasing, on Oct. 12, 1795, for £25, of "Sam-uel March Esqr of Scarborough," one of the Ossipee Pro-prietors, a hundred acres of land "on the Brook that runs out of Horn Pond." Here, in the northeasterly section of the town, he built, about 1799, a saw-mill, known as "Small's Mills," which he and his sons operated for many years. To obtain sufficient power, he built a dam at the Mills, creating an overflow which used to be known as "Small's Mill-Pond." In the "wast-book," it is recorded that "Mr James Small of Ossiby," on Feb. 23, 1791, delivered to "Mr Knock Ilsley of Portland . . . 7,000 shingles on acct of Mr Joshua Small of Ossapy." From this it is inferred that a smaller mill was built, very early, on the site of his later and larger mills.

On Feb. 12, 1802, Daniel Fogg "this Day Settled all Acounts with Capt. James Small," at Limington; the date of death of the latter is not known. The births of his children, and some of their deaths, appear in the "wast-book."
