While proof has not yet been established, the writer suspects the senior James Finley was the brother of John the Elder of Tinkling Spring. The will of James Finley, Sr., written 23 July 1799, names only son, James Finley and grandson, William Finley (Wythe Co., Va., Will Book 1:220). The will of Capt. James Finley, written 15 October 1800, names son, William and "rest of my children," (Wythe Co., Va., Will Book 1:176). This would seem to indicate Capt. James Finley was the son of James Finley, Sr.

Surveyed for James Finley Senr. 191 Acres of Land by Virtue of an entry on a Treasury Warrant of 500 Acres No 13295 dated Aug 3rd 1782 assigned to him by Walter Crockett Attorney for Jas Clerk Lying in Montgomery County on both sides of Read Creek a branch of New river Beginning at a Large white Oak by the Creek Corner to Wm. Phipps Land thence

7 November 1781, James Finley Capt. in room of John Stephens promotted Robert Love First Lieut. Wm. Love Second & Joseph Shaw Ensign in the same Company. Montgomery OB 2:316.

1790, James Finley, Sr. and Capt. James Finley on tax list (Schreiner-Yantis, p. 19); also on lists 1793-1800 (Murphy and Douhat, wythe county, VA Tax List 1793-1800, p. 19).
