Cocke's Will [some spelling errors left uncorrected]
In the name of God Amen, I James Cocke of the Parrish of Cumberland in the County of Lunenburgh do make and ordain this my last Will and Testament in Manner and form following.
Imprimis, I recomend my Soul to almighty God that gave it and my Body to be Buried at the Discretion of my Executors and my Worldly Estate.
I give as followeth (Viz.)
Item I leave unto my Daughter Martha five Hundred Pounds Current money to be Raised of my Estate, and said her to my Executors, when she shall attain to the age of Eighteen years of married, Provided that the said Martha do acquit her Right to a Legace left to her by her grandfather James Powel Cocke as by his said Will, More fully may appear.
Secondly, Item, I leave to my Daughter Elizabeth Two hundred Pounds Curr. Money to be Raised out of my Estate and __ her by my Executors When she shall attain to the age of Eighteen years or Married.
Thirdly, Item, I give and Bequeath unto my son James Cocke my Track [Tract] of Land Cald [Called] Malvern Hills Containing Six hundred and seventy Acres be the same more or less Lying and being in the County of Henrico
I Likewise gave and Bequeath unto my son James another Track [Tract] of Land in the County of Cumberland containing Seven Hundred and fifty Acres to be same more or less to him and his Heirs for Ever.
I likewise gave and Bequeath to my son Son James Sixteen Negroes which I have now on the said Plantation of Malvern Hills and all the Stock and Household goods I have on the said Plantation. I likewise gave him two Negro Boys named Isaac and Sam and Negro girl named Anake and one Wench Nan? ___ and her Child named Stephen which Slaves are now in the County of Lunenburg. I also gave him three Negro Fellows which I have in Amelia County, Viz. Sepes?, Baikas? and Will to him and his heirs for Ever.
Fourthly, Item I gave and Bequeath unto my son Chastain Cocke all the land I hold on the south side of Stanton River in the County of Halifax it being two Thousand five hundred and fifty Acres be the same more or less to him and his heirs forever. I also gave him the following Negroes which I have on the said Land (Viz.) York, Chester, Pompey, Nann and their three Children Sue, and her Child Eave? and her four children. I also gave him the following Negroes (Viz) Holbron?, Ned Moll? and her three Children, old Sue and Doll, Dick, Young Ned and Sara, and also all the Stock that is on the aforesaid Land to him and his heirs for Ever.
Fifthly, Item I gave and Bequeath unto my son Stephen Cocke my Track {Tract] of Land on which I now Dwell, Containing Three Hundred Acres be the same more or less to him and his heirs for Ever. I also gave him the following Negroes which I have on the said Plantation (Viz) Sam, Harry, Jo and Tom. I also gave him the following Negroes which I have in Amelia (Viz) Luce, Jude and her four Children and Nann and What Stock is on the said Plantation to him and his Heirs for Ever.
Sixthly, Item. I lend my Wife my Track [Tract] of land in Amelia containing two Thousand Seven hundred and Seventy one Acres be the same more or less also what Stock I have on the said Plantation and what Negroes Came with her being the number of Twenty one all which I lend her during her Natural life and after her death to Return to son James if he shall survive her, and if he should fail to my son Chastain and in Case the three and the heirs of there Body should fail then to my Daughters and in Case my three sons and two Daughters and the heirs of there [their] Body should all be dec'd. Before my wife, I leave here there after said Twenty one Negroes that was lent her to dispose of as she shall think Proper.
Item I leave unto my Godson James Dupey the sum of Fifty Pounds Current Money to be Paid him by my Executors when he shall Comes to the age of Eighteen Years.
Item, it is my Will that in Cae all my Children should die and leave no heirs of their Body that all my Estate, Except what I left to my Wife Disposhal shall be Equally divided between Braizaure Cocke three Sons.
Item my will further is there be no appraisement of my Estate by Order of Corte [Court] and Lastly I appoint my Nephew John James Dupuy and his son Bartholomew Dupuy and his sonen? San? John Trabue my whole and sole Executors of this my Last Will and Testament Hereby Revoking all other wills therefore made in Witness Whereof I hearunto set my hand and Seal this thirtieth day of April Anno. Dom. one thousand seven hundred and fifty three.

At a Court held for Lunenburgh County the third day of July 1753.
The within Written last will and Testament of James Cocke deceased was Presented in Court by John James Dupuy, Bartholomew Dupey & John Trabue the Executors be Name, and the same was Proved by the oaths of two of the Witnesses there to Subscribed and ordered to be Recorded.
And on the Motion of the said Executors (who made oath and according? to Law), Certificate is Granted them for obtaining a Probat of the said Will in due form of Law (they giving Security)
Whereupon they together with George Walton, Robert Wade, Stephen Mallet and Godfrey Jones their Securities Entered into and acknowledged their Bond according to Law for the said Executors due and faithful Executution of the said Will
