Pg. 202: Will of James Boggs

In the name of God, Amen. I James Boggs of the County of Greenbrier and State of Virginia being of Sound Mind and disposing Memory [for which I thank God] and caling to mind the uncertainty of human life and being desirious to dispose of all such Worldly Estates as it hath pleased God to bless me with i give and bequeath the same in maner following that is to say..

1st Item - to my Well beloved wife Margaret I give and bequeath the mill I now occupie with sufficient timber to keep her in order During her natural life. I also leave to My Said Wife those cows and calves together with all my Household and Kitchen furniture a sufficient garden With one third part of All the fruit that May grow on my or a head Also my old gray Horse all the Above cattle, horse and Household and Kitchen furniture to be at her own Disposal.

I also leave her the _(sum?) of one hundred and twenty dollars that is in the hands of George Reader but if it appears to My Executors that she should need the said one hundred and twenty dollars in that case I leave it to her forever but if that Sum Should be in her hand at her death I leave the same to my grandson James Boggs and my son Alexander's son. I also reserve as much of my meadow as will keep her three cows and calves but she is not keep More than nine head any winter I also leave to my said wife four head of sheeps.

2nd item - To my son, Alexander Boggs, I bequeath the plantation and mill I now live on to be to him and his heirs forever with the reservation of the Mill &c. to his mother as is mentioned in the first item of this instrument.

3rd item - Any other property that I may be in possession of I allow to be sold by my Executors and My Just Debts and Several Expenses paid and this I do Declare to be My Last Will and testament by Me before made and for the Due Execution hereby revoking all other or former Will and testament by Me before made and for the Due Excecution of the same I do hereby appoint My trusty friend, William Renniche and my son, Ezekiel Boggs Executors of this My Last Will and testament.

In Witness whereof I have hereunto Set My hand and Seal this tenth Day of July one thousand Eight Hundred and three.

Greenbrier February Court 1806. This Last Will and testament of James Boggs Dec'd was by the oaths of Wm Renniche and Peter Burr, witnesses thereto and ordered to be Recorded and on the motion of Ezekiel Boggs, one of the Executors therein Named, (William Renniche the other Executor refuses to take upon himself the bauther of administration) and thereupon the Ezekiel Boggs made oath thereto and together with Joseph Hannah and James Bowen his Securities Entered into and acknowledged their bond in the penalty of five Hundred Dollars Conditioned as the law directs Certificate is granted him for obtaining a probat therof in due form.
