James D. Benson enlisted into Company H of the 3rd West Virginia Infantry, later known as the 6th West Virginia Cavalry. He, like many in his family, was an excellent marksman, and was serving as a "designated sharpshooter" on 6/13/1862. He served in this capacity in the Battle of Second Bull Run and Cedar Mountain. On May 3, 1863, he deserted and was later court-martialed and sentenced to "six months hard labor with a six-pound ball attached by a five-foot chain to his left leg, and to forfeit all pay and allowances during this time." He was sentenced on 6/2/1863 and transported to Athenum Prison in Wheeling, and later transferred to Fort Delaware. In December of that year, he had finished out his sentence and rejoined his regiment. On 8/16/1864, he was honorably discharged.

Three weeks later, he married Sarah Wolfe in Fayette County, PA, and settled back in Preston County 2 1/2 years later. In 1890, he was living near Terra Alta, WV. He is one of the veterans whose picture appears in the composite photo of Preston County Civil War Veterans. (Dorothy Bonafield Snyder)
